أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ ثنا الْحَسَنُ بْنُ مُكْرَمٍ ثنا أَبُو النَّضْرِ ثنا مُحَمَّدُ بْنُ رَاشِدٍ عَنْ سُلَيْمَانَ بْنِ مُوسَى عَنْ عَمْرِو بْنِ شُعَيْبٍ عَنْ أَبِيهِ عَنْ جَدِّهِ أَنَّ رَسُولَ اللهِ ﷺ قَضَى أَنَّ كُلَّ مُسْتَلْحَقٍ اسْتُلْحِقَ بَعْدَ أَبِيهِ الَّذِي يُدْعَى إِلَيْهِ فَادَّعَاهُ وَرَثَتُهُ مِنْ بَعْدُ فَقَضَى إِنْ كَانَ مِنْ أَمَةٍ يَمْلِكُهَا يَوْمَ أَصَابَهَا فَقَدْ لَحِقَ بِمَنِ اسْتَلْحَقَهُ لَيْسَ لَهُ فِيمَا قُسِمَ قَبْلَهُ مِنَ الْمِيرَاثِ شَيْءٌ وَمَنْ أَدْرَكَ الْمِيرَاثَ لَمْ يُقْسَمْ فَلَهُ نَصِيبُهُ وَلَا يَلْحَقُ إِذَا كَانَ أَبُوهُ الَّذِي يُدْعَى لَهُ أَنْكَرَهُ فَإِنْ كَانَ مِنْ أَمَةٍ لَا يَمْلِكُهَا أَوْ مِنْ حُرَّةٍ عَاهَرَ بِهَا فَإِنَّهُ لَا يَلْحَقُ وَلَا يَرِثُ وَإِنْ كَانَ أَبُوهُ الَّذِي يُدْعَى لَهُ هُوَ ادَّعَاهُ فَهُوَ وَلَدُ زِنًا لِأَهْلِ أُمِّهِ مَنْ كَانُوا حُرَّةً أَوْ أَمَةً 12505 وَأَخْبَرَنَا أَبُو عَلِيٍّ الرُّوذْبَارِيُّ أنا مُحَمَّدُ بْنُ بَكْرٍ ثنا أَبُو دَاوُدَ ثنا مَحْمُودُ بْنُ خَالِدٍ ثنا أَبِي عَنْ مُحَمَّدِ بْنِ رَاشِدٍ بِإِسْنَادِهِ وَمَعْنَاهُ وَزَادُوا ذَلِكَ فِيمَا اسْتُلْحِقَ فِي أَوَّلِ الْإِسْلَامِ فَمَا اقْتُسِمَ مِنْ مَالٍ قَبْلَ الْإِسْلَامِ فَقَدْ مَضَى
English Translation
Abu Abdullah al-Hafiz informed us with his chain from Sulayman ibn Musa from Amr ibn Shu'ayb from his father from his grandfather that the Messenger of Allah (peace be upon him) ruled that any claimed child who was claimed after the death of the father he was attributed to, and his heirs claimed him: if he was from a slave woman the father owned at the time, the child is joined to the claimant but has no share in wealth divided before his claim. If inheritance has not yet been divided, he receives his share. A child is not joined if the father denied him. If from a slave woman not owned by the father or from a free woman through fornication, the child is not joined, does not inherit, and is not inherited from - he is considered a child of fornication belonging to his mother's people.
