أَخْبَرَنَا أَبُو سَعِيدِ بْنُ أَبِي عَمْرٍو ثنا أَبُو الْعَبَّاسِ الْأَصَمُّ أنا الرَّبِيعُ أنا الشَّافِعِيُّ قَالَ وَقُلْنَا إِذَا أَسْلَمَ الْمَجُوسِيُّ وَابْنَةُ الرَّجُلِ امْرَأَتُهُ أَوْ أُخْتُهُ أُمُّهُ نَظَرْنَا إِلَى أَعْظَمِ النَّسَبَيْنِ فَوَرَّثْنَاهَا بِهِ وَأَلْقَيْنَا الْأُخْرَى وَأَعْظَمُهُمَا أَثْبَتُهُمَا بِكُلِّ حَالٍ فَإِذَا كَانَتْ أُمًّا أُخْتًا وَرَّثْنَاهَا بِأَنَّهَا أُمٌّ وَذَلِكَ أَنَّ الْأُمَّ قَدْ ثَبَتَتْ فِي كُلِّ حَالٍ وَالْأُخْتَ قَدْ تَزُولُ وَهَكَذَا جَمِيعُ فَرَائِضِهِمْ عَلَى هَذِهِ الْمَنَازِلِ وَقَالَ بَعْضُ النَّاسِ أُوَرِّثُهَا مِنَ الْوَجْهَيْنِ مَعًا
English Translation
Abu Sa'id ibn Abi Amr informed us with his chain: al-Rabi' narrated: al-Shafi'i said: 'When a Zoroastrian converts to Islam and his daughter is also his wife, or his sister is his mother, we look at the closer kinship and give inheritance based on that, disregarding the other relationship. The closer relationship is the one that holds in all circumstances. If she was both a mother and a sister, we give inheritance based on motherhood, because motherhood is established in all cases while sisterhood may be removed. Some people said: I give inheritance from both relationships.'
