حَدَّثَنَا قُتَيْبَةُ بْنُ سَعِيدٍ، قَالَ قُرِئَ عَلَى مَالِكٍ وَأَنَا حَاضِرٌ، قَالَ مَالِكٌ عَرَضَ عَلَىَّ نَافِعٌ عَنِ ابْنِ عُمَرَ، أَنَّ عَائِشَةَ، رضى الله عنها أُمَّ الْمُؤْمِنِينَ أَرَادَتْ أَنْ تَشْتَرِيَ جَارِيَةً تَعْتِقُهَا فَقَالَ أَهْلُهَا نَبِيعُكِهَا عَلَى أَنَّ وَلاَءَهَا لَنَا . فَذَكَرَتْ عَائِشَةُ ذَاكَ لِرَسُولِ اللَّهِ صلى الله عليه وسلم فَقَالَ " لاَ يَمْنَعُكِ ذَلِكَ فَإِنَّ الْوَلاَءَ لِمَنْ أَعْتَقَ " .
English Translation
It is narrated by Hadrat Abdullah ibn Umar (may Allah be well pleased with them both) that Umm al-Mu'minin Hadrat Aishah (may Allah be well pleased with her) intended to purchase a slave-girl in order to emancipate her. Her owners said: We shall sell her to you on the condition that the right of patronage (wala') remains with us. Hadrat Aishah (may Allah be well pleased with her) mentioned this to the Beloved Messenger of Allah (blessings and peace of Allah be upon him). He (blessings and peace of Allah be upon him) stated: That should not prevent you from purchasing her, for the right of patronage belongs only to the one who emancipates.
Urdu Translation
حضرت عبداللہ بن عمر رضی اللہ تعالیٰ عنہما سے روایت ہے کہ حضرت اُمّ المؤمنین عائشہ رضی اللہ تعالیٰ عنہا نے ایک لونڈی خرید کر آزاد کرنا چاہا تو اس کے مالکوں نے کہا: ہم اسے آپ کے ہاتھ بیچیں گے مگر اس شرط پر کہ اس کا حقِ ولاء ہمیں حاصل ہو گا۔ حضرت اُمّ المؤمنین عائشہ رضی اللہ تعالیٰ عنہا نے اس بات کا ذکر رسول اللہ صلی اللہ تعالیٰ علیہ وآلہ وسلم سے کیا تو آپ صلی اللہ تعالیٰ علیہ وآلہ وسلم نے ارشاد فرمایا: یہ شرط تمہیں خریدنے سے نہ روکے کیونکہ ولاء تو اسی کا حق ہے جو آزاد کرے۔
