حَدَّثَنَا هُشَيْمٌ، أنا يُونُسُ، عَنِ الْحَسَنِ، أَنَّهُ كَانَ يَقُولُ:" إِذَا قَذَفَ الرَّجُلُ امْرَأَتَهُ فَطَلَّقَهَا ثَلاثًا لاعَنَ حَامِلا كَانَتْ أَوْ غَيْرَ حَامِلٍ، وَإِذَا طَلَّقَهَا ثَلاثًا ثُمَّ قَذَفَهَا فِي الْعِدَّةِ , فَإِنْ كَانَتْ حَامِلا لاعَنَهَا، وَإِنْ لَمْ يَكُنْ حَمْلا جُلِدَ".
English Translation
Al-Hasan said: "If a man accuses his wife and then divorces her three times, he performs li'an whether she is pregnant or not. But if he divorces her three times and then accuses her during the waiting period — if she is pregnant, he performs li'an; if she is not pregnant, he is flogged."
Urdu Translation
حضرت حسن رحمہ اللہ نے فرمایا: اگر کسی نے بیوی کو طلاق دی اور پھر تہمت لگائی تو حاملہ ہو یا نہ ہو، لعان کرے گا، اور اگر تین طلاقوں کے بعد عدت میں تہمت لگائی تو حاملہ ہو تو لعان کرے گا اور نہ ہو تو حد لگائی جائے گی۔[سنن سعید بن منصور/كتاب الطلاق/حدیث: 2752]
