English Translation
Jabir (may Allah be pleased with him) says: The Messenger of Allah (peace be upon him) ruled pre-emption (shuf'ah) in every jointly-owned property that has not been divided, whether it be land or a garden. It is not permissible for one partner to sell his share without informing the other partner; then the other partner has the choice, if he wishes he may take it and if he wishes he may not. Now if he sells it without informing him, then that partner has more right (he may himself take it from the outside person at the same price). [Mukhtasar Sahih Muslim, Hadith: 968]
Urdu Translation
سیدنا جابر رضی اللہ عنہ کہتے ہیں کہرسول اللہصلی اللہ علیہ وسلمنے شفعہ کا ہر اس مشترک مال میں حکم کیا جو بٹا نہ ہو (وہ) زمین ہو یا باغ۔ ایک شریک کو درست نہیں کہ دوسرے شریک کو اطلاع دئیے بغیر اپنا حصہ بیچ ڈالے پھر دوسرے شریک کو اختیار ہے چاہے لے اور چاہے نہ لے۔ اب اگر بغیر اطلاع کے بیچ ڈالے۔ تو وہ شریک زیادہ حقدار ہے (غیر شخص سے اسی دام کو خود لے سکتا ہے)۔[مختصر صحيح مسلم/حدیث: 968]
