حَدَّثَنَا مُحَمَّدُ بْنُ مَحْبُوبٍ، حَدَّثَنَا عَبْدُ الْوَاحِدِ، حَدَّثَنَا مَعْمَرٌ، عَنِ الزُّهْرِيِّ، عَنْ أَبِي سَلَمَةَ بْنِ عَبْدِ الرَّحْمَنِ، عَنْ جَابِرِ بْنِ عَبْدِ اللَّهِ ـ رضى الله عنهما ـ قَالَ قَضَى النَّبِيُّ صلى الله عليه وسلم بِالشُّفْعَةِ فِي كُلِّ مَالٍ لَمْ يُقْسَمْ، فَإِذَا وَقَعَتِ الْحُدُودُ وَصُرِّفَتِ الطُّرُقُ فَلاَ شُفْعَةَ.
English Translation
It is narrated from Hadrat Jabir bin Abdullah (may Allah be well pleased with them both) who states: The Noble Prophet (blessings and peace of Allah be upon him) established the right of pre-emption (Shu'fa) in every undivided joint property. But when the boundaries are demarcated and the pathways are separated, then there is no pre-emption.
Urdu Translation
حضرت جابر بن عبداللہ رضی اللہ تعالیٰ عنہما سے روایت ہے، فرماتے ہیں: نبی کریم صلی اللہ تعالیٰ علیہ وآلہ وسلم نے ہر اس مال میں شفعہ کا حق مقرر فرمایا جو تقسیم نہ ہوا ہو۔ لیکن جب حدود قائم ہو جائیں اور راستے الگ ہو جائیں تو شفعہ (کا حق) باقی نہیں رہتا۔
