أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ حَدَّثَنِي عَلِيُّ بْنُ مُحَمَّدِ بْنِ سَخْتَوَيْهِ الْعَدْلُ ثنا هِشَامُ بْنُ عَلِيٍّ نا عَبْدُ اللهِ بْنُ رَجَاءٍ أنا سَعِيدُ بْنُ سَلَمَةَ بْنِ أَبِي الْحُسَامِ نا عَبْدُ اللهِ بْنُ أَبِي بَكْرٍ عَنْ عَمْرَةَ عَنْ عَائِشَةَ ؓ أَنَّ حَبِيبَةَ بِنْتَ سَهْلٍ تَزَوَّجَتْ ثَابِتَ بْنَ قَيْسِ بْنِ شِمَاسٍ فَأَصْدَقَهَا حَدِيقَتَيْنِ لَهُ وَكَانَ بَيْنَهُمَا اخْتِلَافٌ فَضَرَبَهَا حَتَّى بَلَغَ أَنْ كَسَرَ يَدَهَا فَجَاءَتْ رَسُولَ اللهِ ﷺ فِي الْفَجْرِ فَوَقَفَتْ لَهُ حَتَّى خَرَجَ عَلَيْهَا فَقَالَتْ يَا رَسُولَ اللهِ هَذَا مَقَامُ الْعَائِذِ مِنْ ثَابِتِ بْنِ قَيْسِ بْنِ شِمَاسٍ قَالَ وَمَنْ أَنْتِ؟ قَالَتْ حَبِيبَةُ بِنْتُ سَهْلٍ قَالَ مَا شَأْنُكِ تَرِبَتْ يَدَاكِ؟ قَالَتْ ضَرَبَنِي فَدَعَا النَّبِيُّ ﷺ ثَابِتَ بْنَ قَيْسٍ فَذَكَرَ ثَابِتُ مَا بَيْنَهُمَا فَقَالَ لَهُ النَّبِيُّ ﷺ مَاذَا أَعْطَيْتَهَا؟ قَالَ قِطْعَتَيْنِ مِنْ نَخْلٍ أَوْ حَدِيقَتَيْنِ قَالَ فَهَلْ لَكَ أَنْ تَأْخُذَ بَعْضَ مَالِكَ وَتَتْرُكَ لَهَا بَعْضَهُ؟ قَالَ هَلْ يَصْلُحُ ذَلِكَ يَا رَسُولَ اللهِ؟ قَالَ نَعَمْ فَأَخَذَ إِحْدَاهُمَا فَفَارَقَهَا ثُمَّ تَزَوَّجَهَا أُبَيُّ بْنُ كَعْبٍ ؓ بَعْدَ ذَلِكَ فَخَرَجَ بِهَا إِلَى الشَّامِ فَتُوُفِّيَتْ هُنَالِكَ
English Translation
Aisha (may Allah be pleased with her) narrated that Habibah bint Sahl married Thabit ibn Qays ibn Shammas, and he gave her two gardens as mahr. There was conflict between them, and he struck her until he reportedly broke her hand. She came to the Messenger of Allah (peace be upon him) at dawn and waited until he came out. She said: 'O Messenger of Allah, this is the station of one seeking refuge from Thabit ibn Qays ibn Shammas.' He said: 'Who are you?' She said: 'Habibah bint Sahl.' He said: 'What is the matter with your hands?' She said: 'He struck me.' The Prophet (peace be upon him) summoned Thabit ibn Qays, and Thabit mentioned what was between them. The Prophet (peace be upon him) said to him: 'What did you give her?' He said: 'Two pieces of date palms or two gardens.' He said: 'Would you like to take back some of your wealth and leave her some?' He said: 'Is that permissible, O Messenger of Allah?' He said: 'Yes.' So he took one of them and separated from her. Then Ubayy ibn Ka'b (may Allah be pleased with him) married her after that and went with her to Sham, where she passed away.
