وَأَخْبَرَنَا أَبُو سَعِيدِ بْنُ أَبِي عَمْرٍو ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ أنا الرَّبِيعُ أنا الشَّافِعِيُّ قَالَ وَقَالَ بَعْضُ النَّاسِ بِقَوْلِنَا فِيهِمَا إِلَّا فِي خَصْلَةٍ وَاحِدَةٍ؛ إِذَا كَانَتْ أُمُّهُ عَرَبِيَّةً أَوْ لَا وَلَاءَ لَهَا رَدُّوا مَا بَقِيَ مِنْ مِيرَاثِهِ عَلَى عَصَبَةِ أُمِّهِ وَقَالُوا عَصَبَةُ أُمِّهِ عَصَبَتُهُ وَاحْتَجُّوا فِيهِ بِرِوَايَةٍ لَيْسَتْ بِثَابِتَةٍ وَأُخْرَى لَيْسَتْ مِمَّا تَقُومُ بِهَا حُجَّةٌ
English Translation
Abu Sa'id ibn Abi Amr informed us with his chain: al-Rabi' narrated: al-Shafi'i said: 'Some people agree with our view on these matters except in one particular: when his mother is an Arab woman or has no patronage bond, they return the remainder of his inheritance to his mother's agnates, saying her agnates are his agnates. They cite a narration that is not established and another that does not constitute proof.'
