وَأَخْبَرَنَا أَبُو بَكْرٍ مُحَمَّدُ بْنُ مُحَمَّدٍ أنا أَبُو الْحُسَيْنِ عَبْدُ اللهِ بْنُ إِبْرَاهِيمَ الدَّاوُدِيُّ ثنا أَبُو عَلِيٍّ مُحَمَّدُ بْنُ أَحْمَدَ اللُّؤْلُؤِيُّ ثنا أَبُو دَاوُدَ السِّجِسْتَانِيُّ ثنا حُسَيْنُ بْنُ عَلِيِّ بْنِ الْأَسْوَدِ ثنا يَحْيَى بْنُ آدَمَ ثنا عَمَّارُ بْنُ رُزَيْقٍ عَنْ أَبِي إِسْحَاقَ عَنْ أَبِي سَلَمَةَ بْنِ عَبْدِ الرَّحْمَنِ قَالَ جَاءَ رَجُلٌ إِلَى النَّبِيِّ ﷺ فَقَالَ يَا رَسُولَ اللهِ {يَسْتَفْتُونَكَ قُلِ اللهُ يُفْتِيكُمْ فِي الْكَلَالَةِ} [النساء 176] قَالَ مَنْ لَمْ يَتْرُكْ وَلَدًا وَلَا وَالِدًا فَوَرَثَتُهُ كَلَالَةٌ قَالَ أَبُو دَاوُدَ وَرَوَى عَمَّارٌ عَنْ أَبِي إِسْحَاقَ عَنِ الْبَرَاءِ فِي الْكَلَالَةِ قَالَ تَكْفِيكَ آيَةُ الصَّيْفِ قَالَ الشَّيْخُ هَذَا هُوَ الْمَشْهُورُ وَحَدِيثُ أَبِي إِسْحَاقَ عَنْ أَبِي سَلَمَةَ مُنْقَطِعٌ وَلَيْسَ بِمَعْرُوفٍ
English Translation
Abu Bakr Muhammad ibn Muhammad informed us: Abu al-Husayn Abdullah ibn Ibrahim al-Dawudi informed us: Abu Ali Muhammad ibn Ahmad al-Lu'lu'i narrated to us: Abu Dawud al-Sijistani narrated to us: Husayn ibn Ali ibn al-Aswad narrated to us: Yahya ibn Adam narrated to us: Ammar ibn Ruzayq narrated from Abu Ishaq from Abu Salamah ibn Abd al-Rahman who said: A man came to the Prophet (peace be upon him) and said: O Messenger of Allah, 'They ask you for a ruling. Say: Allah gives you a ruling concerning kalalah' [4:176]. He said: It is one who dies leaving neither a child nor a parent, and his heirs are kalalah. Abu Dawud said: Ammar also narrated from Abu Ishaq from al-Bara' regarding kalalah: The verse of summer suffices you. The Shaykh said: This is the well-known narration, and the hadith of Abu Ishaq from Abu Salamah is disconnected and not well-known.
