English Translation
Waki' told us, Hisham b. Sa'd told us: Yazid b. Nu'aym b. Hazzal informed me, from his father, who said: Ma'iz b. Malik was under the guardianship of my father, and he violated a slave-girl from the tribe. My father said to him: "Go to the Messenger of Allah, peace and blessings be upon him, and tell him what you did; perhaps he will seek forgiveness for you" — intending by that only to hope there might be a way out for him. So he went to him and said: "O Messenger of Allah, I have committed fornication, so carry out upon me the ordinance of the Book of Allah." He turned away from him. Then he came to him a second time and said the same. Then he came to him a third time and said the same. Then he came to him a fourth time and said the same. The Messenger of Allah, peace and blessings be upon him, said: "You have said it four times now — with whom?" He said: "With so-and-so." He said: "Did you lie with her?" He said: "Yes." He said: "Did you touch her intimately?" He said: "Yes." He said: "Did you have intercourse with her?" He said: "Yes." So he ordered that he be stoned. He was taken out to the lava field, and when he was stoned and felt the sting of the stones, he panicked and ran off. 'Abdullah b. Unays met him — his companions having failed to catch him — and pulled out the shin-bone of a camel and threw it at him, killing him. Then he came to the Prophet, peace and blessings be upon him, and mentioned that to him, and he said: "Why did you not leave him be? Perhaps he would have repented and Allah would have accepted his repentance." Hisham said: Yazid b. Nu'aym b. Hazzal told me, from his father, that the Messenger of Allah, peace and blessings be upon him, said to my father when he saw him: "By Allah, O Hazzal, had you covered him with your garment, it would have been better than what you did to him."
