حَدَّثَنَا هَاشِمُ بْنُ الْقَاسِمِ قَالَ حَدَّثَنَا عِكْرِمَةُ عَنْ أَبِي النَّجَاشِيِّ مَوْلَى رَافِعِ بْنِ خَدِيجٍ قَالَ سَأَلْتُ رَافِعًا عَنْ كِرَاءِ الْأَرْضِ قُلْتُ إِنَّ لِي أَرْضًا أُكْرِيهَا فَقَالَ رَافِعٌ لَا تُكْرِهَا بِشَيْءٍ فَإِنِّي سَمِعْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يَقُولُ مَنْ كَانَتْ لَهُ أَرْضٌ فَلْيَزْرَعْهَا فَإِنْ لَمْ يَزْرَعْهَا فَلْيُزْرِعْهَا أَخَاهُ فَإِنْ لَمْ يَفْعَلْ فَلْيَدَعْهَا فَقُلْتُ لَهُ أَرَأَيْتَ إِنْ تَرَكْتُهُ وَأَرْضِي فَإِنْ زَرَعَهَا ثُمَّ بَعَثَ إِلَيَّ مِنْ التِّبْنِ قَالَ لَا تَأْخُذْ مِنْهَا شَيْئًا وَلَا تِبْنًا قُلْتُ إِنِّي لَمْ أُشَارِطْهُ إِنَّمَا أَهْدَى إِلَيَّ شَيْئًا قَالَ لَا تَأْخُذْ مِنْهُ شَيْئًا.
English Translation
Hashim b. al-Qasim narrated to us: Ikrima narrated to us, from Abu al-Najashi, the freedman of Rafi' b. Khadij, who said: "I asked Rafi' about renting out land. I said: 'I have some land which I rent out.' Rafi' said: 'Do not rent it out for anything, for I heard the Messenger of Allah (peace and blessings be upon him) say: Whoever has land, let him cultivate it; and if he does not cultivate it, let him lend it to his brother; and if he does not do that, let him leave it.'" I said to him: "What do you think if I leave it with him along with my land, and if he cultivates it and then sends me some of the straw?" He said: "Do not take anything from it, not even straw." I said: "I did not stipulate anything with him - he merely gave me a gift." He said: "Do not take anything from it."
