حَدَّثَنَا هُشَيْمٌ أَخْبَرَنَا خَالِدٌ عَنِ الْقَاسِمِ بْنِ رَبِيعَةَ بْنِ جَوْشَنٍ عَنْ عُقْبَةَ بْنِ أَوْسٍ عَنْ رَجُلٍ مِنْ أَصْحَابِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ خَطَبَ يَوْمَ فَتْحِ مَكَّةَ فَقَالَ لَا إِلَهَ إِلَّا اللَّهُ وَحْدَهُ نَصَرَ عَبْدَهُ وَهَزَمَ الْأَحْزَابَ وَحْدَهُ قَالَ هُشَيْمٌ مَرَّةً أُخْرَى الْحَمْدُ لِلَّهِ الَّذِي صَدَقَ وَعْدَهُ وَنَصَرَ عَبْدَهُ أَلَا إِنَّ كُلَّ مَأْثَرَةٍ كَانَتْ فِي الْجَاهِلِيَّةِ تُعَدُّ وَتُدَّعَى وَكُلَّ دَمٍ أَوْ دَعْوَى مَوْضُوعَةٌ تَحْتَ قَدَمَيَّ هَاتَيْنِ إِلَّا سِدَانَةَ الْبَيْتِ وَسِقَايَةَ الْحَاجِّ أَلَا وَإِنَّ قَتِيلَ خَطَإِ الْعَمْدِ قَالَ هُشَيْمٌ مَرَّةً بِالسَّوْطِ وَالْعَصَا وَالْحَجَرِ دِيَةٌ مُغَلَّظَةٌ مِائَةٌ مِنْ الْإِبِلِ مِنْهَا أَرْبَعُونَ فِي بُطُونِهَا أَوْلَادُهَا وَقَالَ مَرَّةً أَرْبَعُونَ مِنْ ثَنِيَّةٍ إِلَى بَازِلِ عَامِهَا كُلُّهُنَّ خَلِفَةٌ حَدَّثَنَا هُشَيْمٌ أَخْبَرَنَا حُمَيْدٌ عَنِ الْقَاسِمِ بْنِ رَبِيعَةَ أَنَّهُ قَالَ فِي هَذَا الْحَدِيثِ وَإِنَّ قَتِيلَ خَطَإِ الْعَمْدِ بِالسَّوْطِ وَالْعَصَا وَالْحَجَرِ مِائَةٌ مِنْ الْإِبِلِ مِنْهَا أَرْبَعُونَ فِي بُطُونِهَا أَوْلَادُهَا فَمَنْ ازْدَادَ بَعِيرًا فَهُوَ مِنْ أَهْلِ الْجَاهِلِيَّةِ حَدَّثَنَا هُشَيْمٌ أَخْبَرَنَا يُونُسُ عَنِ الْقَاسِمِ بْنِ رَبِيعَةَ عَنْ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بِقَرِيبٍ مِنْ ذَلِكَ إِلَّا أَنَّهُ قَالَ مِائَةٌ مِنْ الْإِبِلِ ثَلَاثُونَ حِقَّةً وَثَلَاثُونَ جَذَعَةً وَثَلَاثُونَ بَنَاتُ لَبُونٍ وَأَرْبَعُونَ ثَنِيَّةً خَلِفَةً إِلَى بَازِلِ عَامِهِ.
English Translation
Hushaym told us: Khalid informed us, from al-Qasim ibn Rabi'ah ibn Jawshan, from Uqbah ibn Aws, from a man among the Companions of the Prophet, peace and blessings be upon him, that the Prophet, peace and blessings be upon him, delivered a sermon on the day of the Conquest of Mecca and said, "There is no god but Allah alone; He gave victory to His servant alone, and He routed the confederates alone." Hushaym said another time: "Praise be to Allah who fulfilled His promise and gave victory to His servant. Behold, every claim to honor that existed in the Age of Ignorance, that was counted and claimed, and every blood-claim or claim, is placed beneath these two feet of mine, except the custodianship of the House and the provision of water to the pilgrims. Behold, one killed by what resembles intentional-yet-unintentional [killing]" — Hushaym said another time: "by whip, stick, or stone — [its blood-money] is a heavier blood-money: one hundred camels, forty of which are pregnant with their young in their bellies." And he said another time: "forty from the three-year-olds up to those entering their ninth year, all of them pregnant." Hushaym told us: Humayd informed us, from al-Qasim ibn Rabi'ah, that he said in this hadith: "And one killed by what resembles intentional-yet-unintentional killing, by whip, stick, or stone: one hundred camels, forty of which are pregnant with their young in their bellies, and whoever demands an increase of even one camel belongs to the people of the Age of Ignorance." Hushaym told us: Yunus informed us, from al-Qasim ibn Rabi'ah, from the Prophet, peace and blessings be upon him, with something close to that, except that he said: "one hundred camels: thirty three-year-old she-camels, thirty four-year-old she-camels, thirty two-year-old she-camels with young, and forty pregnant she-camels up to the ninth year of their age."
