حَدَّثَنَا مَحْمُودُ بْنُ خَالِدٍ، حَدَّثَنَا الْفِرْيَابِيُّ، عَنِ الأَوْزَاعِيِّ، عَنِ الزُّهْرِيِّ، عَنْ حَرَامِ بْنِ مُحَيِّصَةَ الأَنْصَارِيِّ، عَنِ الْبَرَاءِ بْنِ عَازِبٍ، قَالَ كَانَتْ لَهُ نَاقَةٌ ضَارِيَةٌ فَدَخَلَتْ حَائِطًا فَأَفْسَدَتْ فِيهِ فَكُلِّمَ رَسُولُ اللَّهِ صلى الله عليه وسلم فِيهَا فَقَضَى أَنَّ حِفْظَ الْحَوَائِطِ بِالنَّهَارِ عَلَى أَهْلِهَا وَأَنَّ حِفْظَ الْمَاشِيَةِ بِاللَّيْلِ عَلَى أَهْلِهَا وَأَنَّ عَلَى أَهْلِ الْمَاشِيَةِ مَا أَصَابَتْ مَاشِيَتُهُمْ بِاللَّيْلِ .
English Translation
It is narrated from Hadrat al-Bara' ibn 'Azib (may Allah be well pleased with him) that he had a troublesome she-camel which entered a garden and caused damage in it. The Beloved Messenger of Allah (blessings and peace of Allah be upon him) was informed about it and he judged that the guarding of gardens during the day is upon their owners, and the guarding of livestock during the night is upon their owners, and the owners of livestock are liable for whatever damage their livestock cause at night.
Urdu Translation
حضرت براء بن عازب رضی اللہ تعالیٰ عنہ سے مروی ہے کہ اُن کی ایک بگڑی ہوئی (شریر) اونٹنی تھی جو ایک باغ میں داخل ہوگئی اور اُس میں نقصان کر دیا۔ محبوبِ کریم صلی اللہ تعالیٰ علیہ وآلہ وسلم کو اس کے بارے میں بتایا گیا تو آپ نے فیصلہ فرمایا کہ دن میں باغات کی حفاظت اُن کے مالکوں پر ہے اور رات میں مویشیوں کی حفاظت اُن کے مالکوں پر ہے، اور مویشیوں کے مالکوں پر لازم ہے جو نقصان اُن کے مویشیوں نے رات کو پہنچایا ہو۔
