أَخْبَرَنَا أَبُو بَكْرٍ مُحَمَّدُ بْنُ الْحَسَنِ نا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ أنا الرَّبِيعُ بْنُ سُلَيْمَانَ أنبأ الشَّافِعِيُّ أنا مُسْلِمُ بْنُ خَالِدٍ عَنِ ابْنِ جُرَيْجٍ عَنِ ابْنِ أَبِي مُلَيْكَةَ سَمِعَهُ يَقُولُ تَزَوَّجَ عَقِيلُ بْنُ أَبِي طَالِبٍ فَاطِمَةَ بِنْتَ عُتْبَةَ فَقَالَتْ اصْبِرْ لِي وَأُنْفِقْ عَلَيْكَ فَكَانَ إِذَا دَخَلَ عَلَيْهَا قَالَتْ أَيْنَ عُتْبَةُ بْنُ رَبِيعَةَ وَأَيْنَ شَيْبَةُ بْنُ رَبِيعَةَ فَقَالَ عَلَى يَسَارِكِ فِي النَّارِ إِذَا دَخَلْتِ فَشَدَّتْ عَلَيْهَا ثِيَابَهَا فَجَاءَتْ عُثْمَانَ بْنَ عَفَّانَ ؓ فَذَكَرَتْ لَهُ ذَلِكَ فَأَرْسَلَ ابْنُ عَبَّاسٍ وَمُعَاوِيَةُ ؓ فَقَالَ ابْنُ عَبَّاسٍ لَأُفَرِّقَنَّ بَيْنَهُمَا وَقَالَ مُعَاوِيَةُ مَا كُنْتُ لِأُفَرِّقَ بَيْنَ شَيْخَيْنِ مِنْ بَنِي عَبْدِ مَنَافٍ قَالَ فَأَتَاهُمَا فَوَجَدَهُمَا قَدْ شَدَّا عَلَيْهِمَا أَثْوَابَهُمَا وَأَصْلَحَا أَمْرَهُمَا وَرَوَى عِكْرِمَةُ بْنُ خَالِدٍ عَنِ ابْنِ عَبَّاسٍ قَالَ بُعِثْتُ أَنَا وَمُعَاوِيَةُ حَكَمَيْنِ فَقِيلَ لَنَا إِنْ رَأَيْتُمَا أَنْ تُفَرِّقَا فَرَّقْتُمَا وَإِنْ رَأَيْتُمَا أَنْ تَجْمَعَا جَمَعْتُمَا
الترجمة الإنجليزية
Abu Ali al-Rudhbari informed us... from Abu Hurairah and Zaid bin Khalid al-Juhani (may Allah be pleased with them), that a Bedouin came to the Messenger of Allah (peace be upon him) and said: O Messenger of Allah, I ask you by Allah to judge between us by the Book of Allah. The other disputant, who was more knowledgeable, said: Yes, judge between us by the Book of Allah and permit me to speak first. He said: Speak. He said: My son was a laborer for this man and committed adultery with his wife. I was told that my son deserved stoning, so I ransomed him with a hundred sheep and a slave girl. Then I asked the people of knowledge and they told me that my son deserves a hundred lashes and exile for a year, and that stoning is for this man's wife. The Messenger of Allah (peace be upon him) said: By the One in Whose Hand is my soul, I will judge between you by the Book of Allah. The sheep and the slave girl are to be returned to you. Your son gets a hundred lashes and exile for a year. O Unais, go to this man's wife and if she confesses, stone her. He went to her and she confessed, so he stoned her.
