وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ ثنا أَبُو بَكْرٍ مُحَمَّدُ بْنُ إِسْحَاقَ الصَّغَانِيُّ أنبأ قَبِيصَةُ بْنُ عُقْبَةَ ثنا سُفْيَانُ عَنِ ابْنِ جُرَيْجٍ عَنْ عَطَاءٍ الْخُرَاسَانِيِّ قَالَ جَاءَ رَجُلٌ إِلَى ابْنِ عَبَّاسٍ ؓ فَقَالَ إِنِّي تَزَوَّجْتُ امْرَأَةً وَشَرَطْتُ لَهَا الْفُرْقَةَ وَالْجِمَاعَ بِيَدِهَا فَقَالَ خَالَفْتَ السُّنَّةَ وَوَلَّيْتَ الْأَمْرَ غَيْرَ أَهْلِهِ فَالصَّدَاقُ وَالْفِرَاقُ وَالْجِمَاعُ بِيَدِكَ قَالَ وَجَاءَهُ رَجُلٌ فَقَالَ إِنِّي تَزَوَّجْتُ امْرَأَةً وَشَرَطْتُ لَهَا إِنْ لَمْ أَجِيءْ بِك��ذَا وَكَذَا إِلَى كَذَا وَكَذَا فَلَيْسَ لِي نِكَاحٌ فَقَالَ ابْنُ عَبَّاسٍ النِّكَاحُ جَائِزٌ وَالشَّرْطُ لَيْسَ بِشَيْءٍ
الترجمة الإنجليزية
A man came to Ibn Abbas (may Allah be pleased with him) and said: 'I married a woman and stipulated that she has the right of divorce, separation, and conjugal relations.' Ibn Abbas said: 'You have contradicted the Sunnah and given the authority to other than its rightful holder. The dowry, separation, and conjugal relations are in your hand.' Another man came and said: 'I married a woman and stipulated that if I do not bring such-and-such by such-and-such time, then I have no marriage.' Ibn Abbas said: 'The marriage is valid, and the condition is void.'
