وَأَخْبَرَنَا أَبُو أَحْمَدَ الْمِهْرَجَانِيُّ أنبأ أَبُو بَكْرِ بْنُ جَعْفَرٍ ثنا مُحَمَّدُ بْنُ إِبْرَاهِيمَ ثنا ابْنُ بُكَيْرٍ ثنا مَالِكٌ أَنَّهُ بَلَغَهُ أَنَّ سَعِيدَ بْنَ الْمُسَيِّبِ سُئِلَ عَنِ الْمَرْأَةِ تَشْتَرِطُ عَلَى زَوْجِهَا أَنَّهُ لَا يَخْرُجُ بِهَا مِنْ بَلَدِهَا قَالَ فَقَالَ سَعِيدٌ يَخْرُجُ بِهَا إِنْ شَاءَ وَرُوِّينَا عَنِ الشَّعْبِيِّ فِي رَجُلٍ تَزَوَّجَ امْرَأَةً وَشَرَطَ لَهَا دَارَهَا فَقَالَ زَوْجُهَا دَارُهَا وَرُوِّينَا عَنْ عَمْرِو بْنِ الْعَاصِ ؓ أَنَّهُ قَالَ أَرَى أَنْ يُوفِيَ لَهَا بِشَرْطِهَا وَقَوْلُ الْجَمَاعَةِ أَوْلَى
الترجمة الإنجليزية
Malik reported that it reached him that Sa'id ibn al-Musayyib was asked about a woman who stipulates upon her husband that he not take her out of her town. Sa'id said: 'He may take her out if he wishes.' It was also narrated from al-Sha'bi regarding a man who married a woman and stipulated that she keeps her house: He said: 'Her husband is her house.' And it was narrated from Amr ibn al-As (may Allah be pleased with him) that he said: 'I hold that he should fulfill her condition.' The view of the majority takes precedence.
