حَدَّثَنَا يَحْيَى بْنُ سَعِيدٍ قَالَ حَدَّثَنَا مُجَالِدٌ عَنْ عَامِرٍ قَالَ قَدِمْتُ الْمَدِينَةَ فَأَتَيْتُ فَاطِمَةَ بِنْتَ قَيْسٍ فَحَدَّثَتْنِي أَنَّ زَوْجَهَا طَلَّقَهَا عَلَى عَهْدِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَبَعَثَهُ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِي سَرِيَّةٍ فَقَالَ لِي أَخُوهُ اخْرُجِي مِنْ الدَّارِ فَقُلْتُ إِنَّ لِي نَفَقَةً وَسُكْنَى حَتَّى يَحِلَّ الْأَجَلُ قَالَ لَا قَالَتْ فَأَتَيْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَقُلْتُ إِنَّ فُلَانًا طَلَّقَنِي وَإِنَّ أَخَاهُ أَخْرَجَنِي وَمَنَعَنِي السُّكْنَى وَالنَّفَقَةَ فَأَرْسَلَ إِلَيْهِ فَقَالَ مَا لَكَ وَلِابْنَةِ آلِ قَيْسٍ قَالَ يَا رَسُولَ اللَّهِ إِنَّ أَخِي طَلَّقَهَا ثَلَاثًا جَمِيعًا قَالَتْ فَقَالَ لِي رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ انْظُرِي أَيْ بِنْتَ آلِ قَيْسٍ إِنَّمَا النَّفَقَةُ وَالسُّكْنَى لِلْمَرْأَةِ عَلَى زَوْجِهَا مَا كَانَتْ لَهُ عَلَيْهَا رَجْعَةٌ فَإِذَا لَمْ يَكُنْ لَهُ عَلَيْهَا رَجْعَةٌ فَلَا نَفَقَةَ وَلَا سُكْنَى اخْرُجِي فَانْزِلِي عَلَى فُلَانَةَ ثُمَّ قَالَ إِنَّهُ يُتَحَدَّثُ إِلَيْهَا انْزِلِي عِنْدَ ابْنِ أُمِّ مَكْتُومٍ فَإِنَّهُ أَعْمَى لَا يَرَاكِ ثُمَّ قَالَ لَا تَنْكِحِي حَتَّى أَكُونَ أَنَا أُنْكِحُكِ قَالَتْ فَخَطَبَنِي رَجُلٌ مِنْ قُرَيْشٍ فَأَتَيْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَسْتَأْمِرُهُ فَقَالَ أَلَا تَنْكِحِينَ مَنْ هُوَ أَحَبُّ إِلَيَّ مِنْهُ فَقُلْتُ بَلَى يَا رَسُولَ اللَّهِ فَأَنْكِحْنِي مَنْ أَحْبَبْتَ قَالَتْ فَأَنْكَحَنِي مِنْ أُسَامَةَ بْنِ زَيْدٍ.
الترجمة الإنجليزية
Yahya ibn Sa'id told us, he said Mujalid told us, from Amir, who said: I came to Medina and went to Fatimah bint Qays, and she told me that her husband divorced her during the time of the Messenger of Allah, peace and blessings be upon him, and the Messenger of Allah, peace and blessings be upon him, sent him on a military expedition. His brother said to me, "Leave the house." I said, "I have maintenance and lodging until the term expires." He said, "No." She said: So I came to the Messenger of Allah, peace and blessings be upon him, and said, "So-and-so divorced me, and his brother has expelled me and denied me lodging and maintenance." So he sent for him and said, "What is wrong between you and the daughter of the family of Qays?" He said, "O Messenger of Allah, my brother divorced her with all three divorces together." She said: So the Messenger of Allah, peace and blessings be upon him, said to me, "Look, O daughter of the family of Qays, maintenance and lodging are due to a woman from her husband only as long as he has a right of return over her; if he has no right of return over her, then there is no maintenance and no lodging. Go out and stay with so-and-so." Then he said, "It is said that people visit her; stay instead with Ibn Umm Maktum, for he is blind and cannot see you." Then he said, "Do not marry until I am the one who marries you." She said: A man from Quraysh proposed to me, so I came to the Messenger of Allah, peace and blessings be upon him, to consult him, and he said, "Will you not marry one who is more beloved to me than him?" I said, "Yes indeed, O Messenger of Allah; marry me to whomever you love." She said: So he married me to Usamah ibn Zayd.
