حَدَّثَنَا عَبْدُ الرَّزَّاقِ قَالَ أَنَا ابْنُ جُرَيْجٍ قَالَ أَنَا عَمْرُو بْنُ دِينَارٍ أَنَّهُ سَمِعَ طَاوُسًا يُخْبِرُ عَنِ ابْنِ عَبَّاسٍ عَنْ عُمَرَ رَضِيَ اللَّهُ تَعَالَى عَنْهُ أَنَّهُ نَشَدَ قَضَاءَ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِي ذَلِكَ فَجَاءَ حَمَلُ بْنُ مَالِكِ بْنِ النَّابِغَةِ فَقَالَ كُنْتُ بَيْنَ بَيْتَيْ امْرَأَتَيَّ فَضَرَبَتْ إِحْدَاهُمَا الْأُخْرَى بِمِسْطَحٍ فَقَتَلَتْهَا وَجَنِينَهَا فَقَضَى النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِي جَنِينِهَا بِغُرَّةٍ وَأَنْ تُقْتَلَ بِهَا قُلْتُ لِعَمْرٍو لَا أَخْبَرَنِي عَنْ أَبِيهِ بِكَذَا وَكَذَا قَالَ لَقَدْ شَكَّكْتَنِي.
الترجمة الإنجليزية
'Abd al-Razzaq narrated to us, he said: Ibn Jurayj informed us, he said: 'Amr ibn Dinar informed us, that he heard Tawus relating from Ibn 'Abbas, from 'Umar, may God be pleased with him, that he pursued a judgment of the Messenger of God, peace and blessings be upon him, in that matter. Hamal ibn Malik ibn al-Nabighah came and said: "I was between the tents of my two wives, when one of them struck the other with a tent-pole and killed her and her fetus." So the Prophet, peace and blessings be upon him, ruled, concerning her fetus, that a slave (ghurrah) be given, and that she (the killer) be put to death for her. I said to 'Amr: "Did you not tell me, from your father, such-and-such?" He said: "You have indeed made me doubt."
