نا أَبُو مُعَاوِيَةَ، نا الأَعْمَشُ، عَنْ أَبِي ظَبْيَانَ، قَالَ: أُتِيَ عُمَرُ بْنُ الْخَطَّابِ بِمَجْنُونَةٍ، فَأَمَرَ بِرَجْمِهَا، فَمُرَّ بِهَا عَلَى عَلِيٍّ رَضِيَ اللَّهُ عَنْهُ يَتْبَعُهَا الصِّبْيَانُ، فَقَالَ: مَا هَذِهِ؟ قَالُوا: مَجْنُونَةٌ فَجَرَتْ، فَأَمَرَ عُمَرُ بِرَجْمِهَا، فَقَالَعَلِيٌّرَضِيَ اللَّهُ عَنْهُ: كَمَا أَنْتُمْ، لا تَعْجَلُوا، فَأَتَى عُمَرَ، فَقَالَ:" يَا أَمِيرَ الْمُؤْمِنِينَ! أَمَا عَلِمْتَ أَنَّ" الْقَلَمَ رُفِعَ عَنْ ثَلاثَةٍ: عَنِ النَّائِمِ حَتَّى يَسْتَيْقِظَ، وَالْمَجْنُونِ حَتَّى يَبْرُؤَ، وَعَنِ الصَّغِيرِ حَتَّى يُدْرِكَ"فَقَالَ عُمَرُ: كَذَلِكَ، فَقَالَ عَلِيٌّ لِعُمَرَ: فَرُدَّهَا، وَخَلِّ سَبِيلَهَا.
انگریزی ترجمہ
An insane woman who had committed fornication was brought to Umar, and he ordered her stoning. Ali encountered her being led away, followed by children. He asked about her and was told she was an insane woman who had committed fornication. Ali went to Umar and said: "O Commander of the Faithful! Do you not know that the pen is lifted from three: the sleeping person until he wakes, the insane person until he recovers, and the child until he reaches maturity?" Umar agreed, and Ali said: "Send her back and let her go." So he released her.
اردو ترجمہ
ایک دیوانی عورت فاحشہ ہو گئی تو سیدنا عمر رضی اللہ عنہ نے رجم کا حکم دیا، حضرت علی رضی اللہ عنہ نے کہا:”پاگل پر حد نہیں ہے۔“لہٰذا اسے چھوڑ دیا گیا۔[سنن سعید بن منصور/كتاب الطلاق/حدیث: 3255]
