Narrated Nafi': Ibn Umar (may Allah be pleased with them both) divorced his wife while she was in her menses. So Umar al-Faruq (may Allah be pleased with him) asked the Prophet (peace be upon him) about it. He (peace be upon him) commanded him to take her back and said: "Give her respite until one menses (passes), then give respite until she becomes pure (from that menses), then (if he wishes to divorce) divorce her before having intercourse. This is the time in which Allah the Exalted has commanded that women be divorced." The narrator (Nafi') said: Thereafter, whenever Ibn Umar was asked about a man who divorced his wife while she was in her menses, he would say: If you have given one or two divorces (i.e., revocable), then regarding this the Messenger of Allah (peace be upon him) commanded that he take her back and that he then give her respite for one menses and (attaining) purity from menses, and then divorce her (in a state of purity) before having intercourse. And if you have given her three divorces (i.e., an irrevocable divorce in which there is no taking back), then you have committed disobedience to the command of your Lord in the matter of divorcing your wife, and your wife has become irrevocably separated from you. اردو ترجمہ
نافع سے روایت ہے کہسیدنا ابن عمر رضی اللہ عنہما نے اپنی بیوی کو حیض کی حالت میں طلاق دے دی تو سیدنا عمر فاروق رضی اللہ عنہ نے نبی کریمصلی اللہ علیہ وسلمسے استفسار کیا۔ آپصلی اللہ علیہ وسلمنے انہیں رجوع کرنے کا حکم دیا اور یہ کہا کہ اسے ایک حیض تک مہلت دو۔ پھر مہلت دو کہ (وہ اس حیض سے) پاک ہو جائے، پھر (اگر طلاق دینا چاہے تو) جماع کرنے سے پہلے طلاق دے۔ اور یہ وہ وقت ہے جس میں اللہ تعالیٰ نے عورتوں کو طلاق دینے کا حکم دیا ہے۔ راوی (نافع) نے کہا کہ پھر جب سیدنا ابن عمر سے ایسے آدمی کے بارہ میں پوچھا جاتا کہ جس نے اپنی بیوی کو حیض کی حالت میں طلاق دے دی ہو، تو وہ یہی کہتے کہ اگر تو نے ایک یا دو طلاقیں (یعنی رجعی ہے) دی ہیں تو اس بارہ میں رسول اللہصلی اللہ علیہ وسلمنے رجوع کرنے کا حکم دیا ہے اور یہ کہ پھر اسے ایک حیض اور حیض سے پاکیزگی حاصل کرنے کی مہلت دے، اور پھر اسے (پاکیزگی کی حالت میں) جماع کرنے سے پہلے طلاق دے۔ اور اگر تم نے اسے تین طلاق (یعنی طلاق بائنہ جس میں رجوع نہیں) دی ہے تو تم نے اپنی بیوی کو طلاق دینے کے معاملہ میں اپنے رب کے حکم کی نافرمانی کا ارتکاب کیا ہے اور تمہاری بیوی تم سے (مطلقہ) بائنہ ہو گئی۔[مختصر صحيح مسلم/حدیث: 848]
