وَأَمَّا الَّذِي رُوِيَ عَنْ قَيْسِ بْنِ سَعْدٍ فِي ذَلِكَ فَأَخْبَرَنَاهُ أَبُو طَاهِرٍ الْفَقِيهُ أنبأ أَبُو عُثْمَانَ عَمْرُو بْنُ عَبْدِ اللهِ الْبَصْرِيُّ ثنا أَبُو أَحْمَدَ مُحَمَّدُ بْنُ عَبْدِ الْوَهَّابِ أنبأ يَعْلَى بْنُ عُبَيْدٍ ثنا سُفْيَانُ عَنْ سَلَمَةَ بْنِ كُهَيْلٍ عَنِ الْقَاسِمِ بْنِ مُخَيْمِرَةَ عَنْ أَبِي عَمَّارٍ قَالَ سَأَلْنَا قَيْسَ بْنَ سَعْدٍ عَنْ صَدَقَةِ الْفِطْرِ فَقَالَ أَمَرَنَا بِهَا رَسُولُ اللهِ ﷺ قَبْلَ أَنْ تَنْزِلَ الزَّكَاةُ فَلَمَّا نَزَلَتِ الزَّكَاةُ لَمْ يَأْمُرْنَا وَلَمْ يَنْهَنَا وَنَحْنُ نَفْعَلُهُ قَالَ الشَّيْخُ وَهَذَا لَا يَدُلُّ عَلَى سُقُوطِ فَرْضِهَا؛ لِأَنَّ نُزُولَ فَرْضٍ لَا يُوجِبُ سُقُوطَ آخَرَ وَقَدْ أَجْمَعَ أَهْلُ الْعِلْمِ عَلَى وُجُوبِ زَكَاةِ الْفِطْرِ وَإِنِ اخْتَلَفُوا فِي تَسْمِيَتِهَا فَرْضًا فَلَا يَجُوزُ تَرْكُهَا وَبِاللهِ التَّوْفِيقُ
انگریزی ترجمہ
As for what is narrated from Qays ibn Sa'd regarding that... from Abu Ammar who said: We asked Qays ibn Sa'd about sadaqat al-fitr. He said: 'The Messenger of Allah (peace be upon him) commanded us with it before zakah was revealed. When zakah was revealed, he neither commanded us with it nor prohibited us from it, and we continue to do it.' The Shaykh said: This does not indicate that its obligation has been dropped, because the revelation of one obligation does not necessitate the dropping of another. The scholars have unanimously agreed on the obligatory nature of zakah al-fitr, even if they differ on calling it 'fard.' It is not permissible to abandon it, and success is from Allah.
