أَخْبَرَنَا أَبُو زَكَرِيَّا بْنُ أَبِي إِسْحَاقَ وَغَيْرُهُ قَالُوا ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ أنبأ الرَّبِيعُ بْنُ سُلَيْمَانَ أنبأ الشَّافِعِيُّ أنبأ سُفْيَانُ بْنُ عُيَيْنَةَ ثنا إِسْمَاعِيلُ بْنُ أَبِي خَالِدٍ عَنِ الشَّعْبِيِّ قَالَ جَاءَ رَجُلٌ إِلَى عَلِيٍّ ؓ فَقَالَ إِنِّي وَجَدْتُ أَلْفًا وَخَمْسَمِائَةِ دِرْهَمٍ فِي خَرِبَةٍ فِي السَّوَادِ فَقَالَ عَلِيٌّ ؓ أَمَا لَأَقْضِيَنَّ فِيهَا قَضَاءً بَيِّنًا إِنْ كُنْتَ وَجَدْتَهَا فِي قَرْيَةٍ تُؤَدِّي خَرَاجَهَا قَرْيَةٌ أُخْرَى فَهِيَ لِأَهْلِ تِلْكَ الْقَرْيَةِ وَإِنْ كُنْتَ وَجَدْتَهَا فِي قَرْيَةٍ لَيْسَ تُؤَدِّي خَرَاجَهَا قَرْيَةٌ أُخْرَى فَلَكَ أَرْبَعَةُ أَخْمَاسِهِ وَلَنَا الْخُمُسُ ثُمَّ الْخُمُسُ لَكَ قَالَ الشَّافِعِيُّ قَدْ رَوَوْا عَنْ عَلِيٍّ ؓ بِإِسْنَادٍ مَوْصُولٍ أَنَّهُ قَالَ أَرْبَعَةُ أَخْمَاسِهِ لَكَ وَاقْسِمِ الْخُمُسَ فِي فُقَرَاءِ أَهْلِكَ هَذَا الْحَدِيثُ أَشْبَهُ بِعَلِيٍّ ؓ وَاللهُ أَعْلَمُ قَالَ الشَّيْخُ هُوَ كَمَا قَالَ 7655 فَقَدْ رَوَى سَعِيدُ بْنُ مَنْصُورٍ الْمَكِّيُّ فِي كِتَابِهِ عَنِ ابْنِ عُيَيْنَةَ عَنْ عَبْدِ اللهِ بْنِ بِشْرٍ الْخَثْعَمِيِّ عَنْ رَجُلٍ مِنْ قَوْمِهِ يُقَالُ لَهُ حُمَمَةُ قَالَ سَقَطَتْ عَلَيَّ جَرَّةٌ مِنْ دَيْرٍ قَدْيمٍ بِالْكُوفَةِ فِيهَا أَرْبَعَةُ آلَافِ دِرْهَمٍ فَذَهَبْتُ بِهَا إِلَى عَلِيٍّ ؓ فَقَالَ اقْسِمْهَا خَمْسَةَ أَخْمَاسٍ فَقَسَمْتُهَا فَأَخَذَ مِنْهَا عَلِيٌّ ؓ خُمُسًا وَأَعْطَانِي أَرْبَعَةَ أَخْمَاسٍ فَلَمَّا أَدْبَرْتُ دَعَانِي فَقَالَ فِي جِيرَانِكَ فُقَرَاءُ وَمَسَاكِينُ قُلْتُ نَعَمْ قَالَ خُذْهَا فَاقْسِمْهَا بَيْنَهُمْ
انگریزی ترجمہ
Abu Zakariyya ibn Abi Ishaq and others informed us... from al-Sha'bi who said: A man came to Ali (may Allah be pleased with him) and said: 'I found fifteen hundred dirhams in a ruin in the Sawad (fertile land of Iraq).' Ali (may Allah be pleased with him) said: 'I will render a clear judgment. If you found it in a village whose land tax is paid by another village, then it belongs to the people of that village. But if you found it in a village whose land tax is not paid by another village, then four-fifths are yours and one-fifth is ours. Then the fifth is also for you.' Al-Shafi'i said: They narrated from Ali with a connected chain that he said: 'Four-fifths are yours, and distribute the fifth among the poor of your family.' This hadith is more befitting of Ali. The Shaykh said: It is as he said. Sa'id ibn Mansur narrated a similar report about a man who found a jar containing four thousand dirhams from an ancient monastery in Kufa, and Ali divided it into fifths, took one fifth, gave the man four fifths, then asked if there were poor in his neighborhood and told him to distribute the fifth among them.
