أَخْبَرَنَا أَبُو الْحَسَنِ عَلِيُّ بْنُ مُحَمَّدِ بْنِ يُوسُفَ الرَّفَّاءُ الْبَغْدَادِيُّ أنبأ أَبُو عَمْرٍو عُثْمَانُ بْنُ مُحَمَّدِ بْنِ بِشْرٍ ثنا إِسْمَاعِيلُ بْنُ إِسْحَاقَ الْقَاضِي ثنا إِسْمَاعِيلُ بْنُ أَبِي أُوَيْسٍ وَعِيسَى بْنُ مِينَاءَ قَالُونُ قَالَا ثنا عَبْدُ الرَّحْمَنِ بْنُ أَبِي الزِّنَادِ أَنَّ أَبَاهُ قَالَ مَنْ أَدْرَكْتُ مِنْ فُقَهَائِنَا الَّذِينَ يُنْتَهَى إِلَى قَوْلِهِمْ مِنْهُمْ سَعِيدُ بْنُ الْمُسَيِّبِ وَعُرْوَةُ بْنُ الزُّبَيْرِ وَالْقَاسِمُ بْنُ مُحَمَّدِ وَأَبُو بَكْرِ بْنُ عَبْدِ الرَّحْمَنِ وَخَارِجَةُ بْنُ زَيْدِ بْنِ ثَابِتٍ وَعُبَيْدُ اللهِ بْنُ عَبْدِ اللهِ بْنِ عُتْبَةَ وَسُلَيْمَانُ بْنُ يَسَارٍ فِي مَشْيَخَةٍ جُلَّةٍ سِوَاهُمْ وَرُبَّمَا اخْتَلَفُوا فِي الشَّيْءِ فَأَخَذْنَا بِقَوْلِ أَكْثَرِهِمْ وَأَفْضَلِهِمْ رَأْيًا فَذَكَرَ أَحْكَامًا قَالَ وَكَانُوا يَقُولُونَ لَا صَدَقَةَ فِي تَمْرٍ وَلَا حَبٍّ حَتَّى يَبْلُغَ خَرْصُ التَّمْرِ أَوْ مَكِيلَةُ الْحَبِّ خَمْسَةَ أَوْسُقٍ بِصَاعِ النَّبِيِّ ﷺ وَكَانُوا لَا يَرَوْنَ الزَّكَاةَ فِي شَيْءٍ مِنَ الْفَوَاكِهِ إِلَّا فِي الْعِنَبِ إِذَا بَلَغَ خُرْصُهُ خَمْسَةَ أَوْسُقٍ بِصَاعِ النَّبِيِّ ﷺ وَكَانُوا يَرَوْنَ فِي كُلِّ نَيِّفٍ مِنَ الذَّهَبِ وَالْوَرِقِ وَالتَّمْرِ وَالْحَبِّ وَالْعِنَبِ صَدَقَةً وَلَوْ زَادَ مُدًّا أَوْ أَكْثَرَ أَوْ أَقَلَّ وَلَمْ يَكُونُوا يَرَوْنَ فِي نَيِّفِ الْمَاشِيَةِ صَدَقَةَ الْإِبِلِ وَالْبَقَرِ وَالْغَنَمِ وَرُوِّينَا عَنْ إِبْرَاهِيمَ النَّخَعِيِّ أنَّهُ قَالَ مَا زَادَ يَعْنِي عَلَى الْمِائَتَيْنِ فَبِالْحِسَابِ

Abu al-Hasan Ali ibn Muhammad ibn Yusuf al-Raffa' al-Baghdadi informed us: Abu Amr Uthman ibn Muhammad ibn Bishr narrated to us: Isma'il ibn Ishaq the Judge narrated to us: Isma'il ibn Abi Uwais and Isa ibn Mina' Qalun narrated to us: Abd al-Rahman ibn Abi al-Zinad said: The jurists whom I knew and whose opinions were authoritative - among them Sa'id ibn al-Musayyib, Urwa ibn al-Zubayr, al-Qasim ibn Muhammad, Abu Bakr ibn Abd al-Rahman, Kharija ibn Zayd ibn Thabit, Ubaydullah ibn Abdullah ibn Utba, and Sulayman ibn Yasar, along with other senior scholars - sometimes disagreed on matters, and we would follow the opinion of the majority and the most insightful among them. He mentioned various rulings, including: They used to say there is no charity on dates or grain until the estimate of dates or the measure of grain reaches five wasq by the measure of the Prophet (peace be upon him). They did not consider zakah due on any fruits except grapes, when their estimate reached five wasq by the measure of the Prophet (peace be upon him). They considered zakah due on any excess of gold, silver, dates, grain, and grapes, even if it exceeded by a single mudd or more or less. They did not consider zakah due on the excess of livestock - camels, cattle, and sheep. It is also narrated from Ibrahim al-Nakha'i that he said: Whatever exceeds - meaning the two hundred - it is calculated proportionally.
