وَأَخْبَرَنَا أَبُو الْفَتْحِ هِلَالُ بْنُ مُحَمَّدِ بْنِ جَعْفَرٍ الْحَفَّارُ ثنا أَبُو عَبْدِ اللهِ الْحُسَيْنُ بْنُ يَحْيَى بْنِ عَيَّاشٍ الْقَطَّانُ ثنا أَبُو الْأَشْعَثِ ثنا مُحَمَّدُ بْنُ بَكْرٍ عَنِ ابْنِ جُرَيْجٍ أَخْبَرَنِي مُوسَى بْنُ عُقْبَةَ عَنْ نَافِعٍ عَنِ ابْنِ عُمَرَ أنَّهُ كَانَ يَقُولُ صَدَقَةُ الثِّمَارِ وَالزَّرْعِ مَا كَانَ مِنْ نَخْلٍ أَوْ عِنَبٍ أَوْ زَرْعٍ مِنْ حِنْطَةٍ أَوْ شَعِيرٍ أَوْ سُلْتٍ وَسُقِيَ بِنَهْرٍ أَوْ سُقِيَ بِالْعَيْنِ أَوْ عَثَرِيًّا يُسْقَى بِالْمَطَرِ فَفِيهِ الْعُشْرُ مِنْ كُلِّ عَشَرَةٍ وَاحِدٌ وَمَا كَانَ يُسْقَى بِالنَّضْحِ فَفِيهِ نِصْفُ الْعُشْرِ مِنْ كُلِّ عِشْرِينَ وَاحِدٌ وَكَتَبَ النَّبِيُّ ﷺ إِلَى أَهْلِ الْيَمَنِ إِلَى الْحَارِثِ بْنِ عَبْدِ كُلَالٍ وَمَنْ مَعَهُ مِنْ مَعَافِرَ وَهَمْدَانَ عَلَى الْمُؤْمِنِينَ فِي صَدَقَةِ الثِّمَارِ أَوْ قَالَ الْعَقَارُ عُشْرُ مَا تَسْقِي الْعَيْنُ وَمَا سَقَتِ السَّمَاءُ وَعَلَى مَا يُسْقَى بِالْغَرْبِ نِصْفُ الْعُشْرِ قَالَ الشَّيْخُ هَكَذَا وَجَدْتُهُ مَوْصُولًا بِالْحَدِيثِ وَفِي قَوْلِهِ عَلَى الْمُؤْمِنِينَ كَالدَّلَالَةِ عَلَى أَنَّهَا لَا تُؤْخَذُ مِنْ أَهْلِ الذِّمَّةِ وَاللهُ أَعْلَمُ
انگریزی ترجمہ
Abu al-Fath Hilal ibn Muhammad ibn Ja'far al-Haffar narrated to us... from Ibn 'Umar, who used to say: 'The charity on fruits and crops - whether from palm trees, grapes, or crops of wheat, barley, or sult - what is watered by rivers, springs, or by rain (athariyan), the tithe is due: one in every ten. What is watered by water-wheels, half the tithe is due: one in every twenty.' And the Prophet (peace be upon him) wrote to the people of Yemen to al-Harith ibn 'Abd Kulal and those with him of Ma'afir and Hamdan: 'Upon the believers in the charity of fruits or property is the tithe of what is watered by springs and rain, and upon what is watered by buckets is half the tithe.' The Shaykh said: I found this connected to the hadith. His saying 'upon the believers' is as if indicating that it is not taken from the People of the Covenant (dhimmis). And Allah knows best.
