أَخْبَرَنَا أَبُو سَعِيدِ بْنُ أَبِي عَمْرٍو ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ ثنا الْحَسَنُ بْنُ عَلِيِّ بْنِ عَفَّانَ ثنا يَحْيَى بْنُ آدَمَ ثنا عَبْدُ الرَّحْمَنِ بْنُ حُمَيْدٍ الرُّوَاسِيُّ عَنْ جَعْفَرِ بْنِ نَجِيحٍ السَّعْدِيِّ الْمَدَنِيِّ عَنْ بِشْرِ بْنِ عَاصِمٍ وَعُثْمَانَ بْنِ عَبْدِ اللهِ بْنِ أَوْسٍ أَنَّ سُفْيَانَ بْنَ عَبْدِ اللهِ الثَّقَفِيَّ كَتَبَ إِلَى عُمَرَ بْنِ الْخَطَّابِ ؓ وَكَانَ عَا��ِلًا لَهُ عَلَى الطَّائِفِ فَكَتَبَ إِلَيْهِ أَنَّ قِبَلَهُ حِيطَانًا فِيهَا كُرُومٌ وَفِيهَا مِنَ الْفِرْسِكِ وَالرُّمَّانِ مَا هُوَ أَكْثَرُ غَلَّةً مِنَ الْكُرُومِ أَضْعَافًا فَكَتَبَ إِلَيْهِ يَسْتَأْمِرُهُ فِي الْعُشْرِ فَكَتَبَ إِلَيْهِ عُمَرُ أنَّهُ لَيْسَ عَلَيْهَا عُشْرٌ قَالَ هِيَ مِنَ الْعِضَاهِ كُلِّهَا فَلَيْسَ عَلَيْهَا عُشْرٌ وَهَذَا قَوْلُ مُجَاهِدٍ وَالْحَسَنِ وَالنَّخَعِيِّ وَعَمْرِو بْنِ دِينَارٍ وَرُوِّينَاهُ عَنِ الْفُقَهَاءِ السَّبْعَةِ مِنْ تَابِعِي أَهْلِ الْمَدِينَةِ
انگریزی ترجمہ
Abu Sa'id ibn Abi 'Amr narrated to us... from Bishr ibn 'Asim and 'Uthman ibn 'Abdullah ibn Aws, that Sufyan ibn 'Abdullah al-Thaqafi wrote to 'Umar ibn al-Khattab (may Allah be pleased with him), while he was his governor over al-Ta'if, informing him that in his jurisdiction there were gardens with grapevines, and in them were peaches and pomegranates that yielded many times more than the grapevines. He wrote asking him about the tithe. 'Umar wrote to him: 'There is no tithe on them. They are all from the wild trees, so there is no tithe on them.' This is the view of Mujahid, al-Hasan, al-Nakha'i, and 'Amr ibn Dinar, and we have narrated it from the seven jurists among the Successors of Madinah.
