وَمِنْهَا مَا أَخْبَرَنَا أَبُو عَلِيٍّ الرُّوذْبَارِيُّ أنبأ مُحَمَّدُ بْنُ بَكْرٍ ثنا أَبُو دَاوُدَ ثنا عَيَّاشُ بْنُ الْوَلِيدِ الرَّقَّامُ ثنا عَبْدُ الْأَعْلَى ثنا سَعِيدٌ عَنْ قَتَادَةَ عَنِ الْحَسَنِ عَنْ سَمُرَةَ بْنِ جُنْدُبٍ ؓ أَنَّ نَبِيَّ اللهِ ﷺ قَالَ إِذَا أَتَى أَحَدُكُمْ عَلَى مَاشِيَةٍ فَإِنْ كَانَ فِيهَا صَاحِبُهَا فَلْيَسْتَأْذِنْهُ فَإِنْ أَذِنَ لَهُ فَلْيَحْتَلِبْ وَلْيَشْرَبْ وَإِنْ لَمْ يَكُنْ فِيهَا فَلْيُصَوِّتْ ثَلَاثًا فَإِنْ أَجَابَهُ فَلْيَسْتَأْذِنْهُ وَإِلَّا فَلْيَحْتَلِبْ وَلْيَشْرَبْ وَلَا يَحْمِلْ قَالَ الشَّيْخُ أَحَادِيثُ الْحَسَنِ عَنْ سَمُرَةَ لَا يُثْبِتُهَا بَعْضُ الْحُفَّاظِ وَيَزْعُمُ أَنَّهَا مِنْ كِتَابٍ غَيْرَ حَدِيثِ الْعَقِيقَةِ الَّذِي قَدْ ذُكِرَ فِيهِ السَّمَاعُ وَإِنْ صَحَّ فَهُوَ مَحْمُولٌ عَلَى حَالِ الضَّرُورَةِ
انگریزی ترجمہ
And among them is what Abu Ali al-Rudhbari informed us: Muhammad ibn Bakr reported to us: Abu Dawud narrated to us: Ayyash ibn al-Walid al-Raqqam narrated to us: Abd al-A'la narrated to us: Sa'id narrated to us, from Qatadah, from al-Hasan, from Samurah ibn Jundub (may Allah be pleased with him), that the Prophet of Allah (peace and blessings be upon him) said: "When one of you comes upon livestock: if their owner is present, let him ask his permission; and if he permits him, let him milk and drink. And if he [the owner] is not present, let him call out three times; if he answers him, let him ask his permission; otherwise let him milk and drink, but not carry [any] away." The Shaykh said: The hadiths of al-Hasan from Samurah are not affirmed [as connected] by some of the memorizers (huffaz), who hold that they are from a written record (kitab) — except for the hadith of the Aqiqah, in which direct hearing (sama') is mentioned. And if it is authentic, it is understood to apply to a state of necessity.
