أَخْبَرَنَا أَبُو سَعِيدِ بْنُ أَبِي عَمْرٍو ثنا أَبُو الْعَبَّاسِ الْأَصَمُّ أنبأ الرَّبِيعُ بْنُ سُلَيْمَانَ قَالَ قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ وَنَهَى عُمَرُ بْنُ الْخَطَّابِ ؓ عَنِ النَّخْعِ وَأَنْ تُعْجَلَ الْأَنْفُسُ أَنْ تَزْهَقَ قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ وَالنَّخْعُ أَنْ تُذْبَحَ الشَّاةُ ثُمَّ يُكْسَرُ قَفَاهَا مِنْ مَوْضِعِ الذَّبْحِ لِنَخْعِهِ وَلِمَكَانِ الْكَسْرِ فِيهِ أَوْ تُضْرَبَ لِيُعْجَلَ قَطْعُ حَرَكَتِهَا فَأَكْرَهُ هَذَا وَقَالَ وَلَمْ يُحَرِّمْهَا ذَلِكَ لِأَنَّهَا ذَكِيَّةٌ
انگریزی ترجمہ
Abu Sa'id ibn Abi Amr informed us, Abu al-Abbas al-Asamm informed us, al-Rabi' ibn Sulayman informed us, al-Shafi'i (may Allah have mercy on him) said: Umar ibn al-Khattab (may Allah be pleased with him) prohibited nakh' (breaking the neck before death) and hastening the souls to depart. Al-Shafi'i (may Allah have mercy on him) said: Nakh' is when a sheep is slaughtered and then its neck is broken at the place of slaughter, due to the breaking at that spot, or it is struck to hasten the cessation of its movement. I dislike this, but he said: This does not render it unlawful, because it has been properly slaughtered.
