أَخْبَرَنَا أَبُو سَعِيدِ بْنُ أَبِي عَمْرٍو ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ ثنا الْحَسَنُ بْنُ عَلِيِّ بْنِ عَفَّانَ ثنا يَحْيَى بْنُ آدَمَ ثنا زُهَيْرُ بْنُ مُعَاوِيَةَ عَنِ الْحَسَنِ بْنِ الْحُرِّ عَنْ نَافِعٍ عَنْ أَسْلَمَ عَنْ عُمَرَ ؓ أَنَّهُ كَتَبَ إِلَى أُمَرَاءِ أَهْلِ الْجِزْيَةِ أَنْ لَا يَضْرِبُوا الْجِزْيَةَ إِلَّا عَلَى مَنْ جَرَتْ عَلَيْهِ الْمَوَاسِي قَالَ وَكَانَ لَا يَضْرِبُ الْجِزْيَةَ عَلَى النِّسَاءِ وَالصِّبْيَانِ قَالَ يَحْيَى وَهَذَا الْمَعْرُوفُ عِنْدَ أَصْحَابِنَا
انگریزی ترجمہ
Abu Sa'id ibn Abi 'Amr informed us, Abu al-'Abbas Muhammad ibn Ya'qub narrated to us, al-Hasan ibn 'Ali ibn 'Affan narrated to us, Yahya ibn Adam narrated to us, Zuhayr ibn Mu'awiyah narrated to us from al-Hasan ibn al-Hurr, from Nafi', from Aslam, from 'Umar (may Allah be pleased with him), that he wrote to the commanders of the jizya territories that they should not impose the jizya except upon those who have reached puberty (upon whom the razor has passed). And he would not impose the jizya upon women and children. Yahya said: "This is the well-known position among our companions."
