أَخْبَرَنَا أَبُو عَبْدِ الرَّحْمَنِ السُّلَمِيُّ وَأَبُو بَكْرِ بْنُ الْحَارِثِ الْأَصْبَهَانِيُّ قَالَ أنا عَلِيُّ بْنُ عُمَرَ الْحَافِظُ ثنا الْحُسَيْنُ بْنُ إِسْمَاعِيلَ ثنا يَعْقُوبُ الدَّوْرَقِيُّ ثنا إِسْمَاعِيلُ ابْنُ عُلَيَّةَ ثنا هِشَامٌ الدَّسْتُوَائِيُّ قَالَ كُتِبَ إِلَى يَحْيَى بْنِ أَبِي كَثِيرٍ يُحَدِّثُ عَنْ عِكْرِمَةَ أَنَّ عُمَرَ ؓ قَالَ الْحَرَامُ يَمِينٌ يُكَفِّرُهَا 15056 قَالَ هِشَامٌ وَكُتِبَ إِلَى يَحْيَى بْنِ أَبِي كَثِيرٍ عَنْ يَعْلَى بْنِ حَكِيمٍ عَنْ سَعِيدِ بْنِ جُبَيْرٍ عَنِ ابْنِ عَبَّاسٍ أَنَّهُ كَانَ يَقُولُ فِي الْحَرَامِ يَمِينٌ يُكَفِّرُهَا وَقَالَ {لَقَدْ كَانَ لَكُمْ فِي رَسُولِ اللهِ أُسْوَةٌ حَسَنَةٌ} [الأحزاب 21] يَعْنِي أَنَّ النَّبِيَّ ﷺ كَانَ حَرَّمَ جَارِيَةً فَقَالَ اللهُ {لِمَ تُحَرِّمُ مَا أَحَلَّ اللهُ لَكَ} [التحريم 1] إِلَى قَوْلِهِ {قَدْ فَرَضَ اللهُ لَكُمْ تَحِلَّةَ أَيْمَانِكُمْ} [التحريم 2] فَكَفَّرَ يَمِينَهُ وَصَيَّرَ الْحَرَامَ يَمِينًا
انگریزی ترجمہ
Umar (may Allah be pleased with him) said: Declaring something forbidden (haram) is an oath that requires expiation. Hisham also wrote to Yahya ibn Abi Kathir from Ya'la ibn Hakim from Sa'id ibn Jubayr from Ibn Abbas that he used to say regarding the declaration of forbidden: It is an oath that requires expiation. He said: {There has certainly been for you in the Messenger of Allah an excellent example} [al-Ahzab 21], meaning that the Prophet (peace be upon him) had declared his slave-girl forbidden, and Allah said: {Why do you prohibit what Allah has made lawful for you?} [al-Tahrim 1] until His saying: {Allah has already ordained for you the dissolution of your oaths} [al-Tahrim 2]. So he expiated his oath and made the forbidden into an oath.
