أَخْبَرَنَا أَبُو سَعِيدِ بْنُ أَبِي عَمْرٍو أنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ أنا الرَّبِيعُ قَالَ قَالَ الشَّافِعِيُّ حِكَايَةً عَنْ أَبِي مُعَاوِيَةَ وَيَعْلَى عَنِ الْأَعْمَشِ عَنْ إِبْرَاهِيمَ عَنْ مَسْرُوقٍ أَنَّ امْرَأَةً قَالَتْ لِزَوْجِهَا لَوْ أَنَّ الْأَمْرَ الَّذِي بِيَدِكَ بِيَدِي لَطَلَّقْتُكَ قَالَ قَدْ جَعَلْتُ الْأَمْرَ إِلَيْكِ فَطَلَّقَتْ نَفْسَهَا ثَلَاثًا فَسَأَلَ عُمَرُ وَعَبْدَ اللهِ ؓ عَنْ ذَلِكَ قَالَ هِيَ وَاحِدَةٌ وَهُوَ أَحَقُّ بِهَا فَقَالَ عُمَرُ ؓ وَأَنَا أَرَى ذَلِكَ 15037 وَعَنِ الشَّافِعِيِّ حِكَايَةً عَنْ عُبَيْدِ اللهِ بْنِ مُوسَى عَنِ ابْنِ أَبِي لَيْلَى عَنْ طَلْحَةَ عَنْ إِبْرَاهِيمَ عَنْ عَلْقَمَةَ عَنْ عَبْدِ اللهِ قَالَ لَا يَكُونُ طَلَاقٌ بَائِنٌ إِلَّا خُلْعٌ أَوْ إِيلَاءٌ
انگریزی ترجمہ
Al-Shafi'i narrated from Abu Mu'awiyah and Ya'la from al-A'mash from Ibrahim from Masruq that a woman said to her husband: If the authority that is in your hand were in mine, I would divorce you. He said: I have placed the matter in your hands. She divorced herself three times. Umar and Abdullah (may Allah be pleased with them) were asked about it. They said: It counts as one divorce and he has more right to her. Umar (may Allah be pleased with him) said: I hold the same view. Al-Shafi'i also narrated from 'Ubaydullah ibn Musa from Ibn Abi Layla from Talhah from Ibrahim from 'Alqamah from Abdullah who said: There is no irrevocable divorce except through khul' or ila'.
