وَأَخْبَرَنَا أَبُو زَكَرِيَّا بْنُ أَبِي إِسْحَاقَ أنبأ أَبُو الْحَسَنِ أَحْمَدُ بْنُ مُحَمَّدِ بْنِ عَبْدُوسٍ ثنا عُثْمَانُ بْنُ سَعِيدٍ ثنا عَبْدُ اللهِ بْنُ صَالِحٍ عَنْ مُعَاوِيَةَ بْنِ صَالِحٍ عَنْ عَلِيِّ بْنِ أَبِي طَلْحَةَ عَنِ ابْنِ عَبَّاسٍ فِي قَوْلِهِ تَعَالَى {إِلَّا أَنْ يَعْفُونَ} [البقرة 237] قَالَ هِيَ الْمَرْأَةُ الثَّيِّبُ أَوِ الْبِكْرُ يُزَوِّجُهَا غَيْرُ أَبِيهَا فَجَعَلَ اللهُ الْعَفْوَ إِلَيْهِنَّ إِنْ شِئْنَ تَرَكْنَ وَإِنْ شِئْنَ أَخَذْنَ نِصْفَ الصَّدَاقِ ثُمَّ قَالَ {أَوْ يَعْفُوَ الَّذِي بِيَدِهِ عُقْدَةُ النِّكَاحِ} [البقرة 237] وَهُوَ أَبُو الْجَارِيَةِ الْبِكْرِ جَعَلَ اللهُ الْعَفْوَ إِلَيْهِ لَيْسَ لَهَا مَعَهُ أَمْرٌ إِذَا طُلِّقَتْ مَا كَانَتْ فِي حِجْرِهِ
انگریزی ترجمہ
Ibn Abbas regarding the words of the Exalted: 'Unless they forgo it' (2:237), said: She is the mature or virgin woman married off by other than her father. Allah gave the right of forgiveness to them - if they wish, they relinquish it; if they wish, they take half the dowry. Then He said: 'Or he in whose hand is the marriage tie forgoes it' - meaning the father of the virgin girl. Allah gave the right of forgiveness to him; she has no say with him as long as she is under his care when divorced.
