حَدَّثَنَا ابْنُ إِدْرِيسَ سَمِعْتُ ابْنَ إِسْحَاقَ عَنْ عَمْرِو بْنِ شُعَيْبٍ عَنْ أَبِيهِ عَنْ جَدِّهِ قَالَ سَمِعْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَرَجُلًا مِنْ مُزَيْنَةَ يَسْأَلُهُ عَنْ ضَالَّةِ الْإِبِلِ فَقَالَ مَعَهَا حِذَاؤُهَا وَسِقَاؤُهَا تَأْكُلُ الشَّجَرَ وَتَرِدُ الْمَاءَ فَذَرْهَا حَتَّى يَأْتِيَ بَاغِيهَا قَالَ وَسَأَلَهُ عَنْ ضَالَّةِ الْغَنَمِ فَقَالَ لَكَ أَوْ لِأَخِيكَ أَوْ لِلذِّئْبِ اجْمَعْهَا إِلَيْكَ حَتَّى يَأْتِيَ بَاغِيهَا وَسَأَلَهُ عَنْ الْحَرِيسَةِ الَّتِي تُوجَدُ فِي مَرَاتِعِهَا قَالَ فَقَالَ فِيهَا ثَمَنُهَا مَرَّتَيْنِ وَضَرْبُ نَكَالٍ قَالَ فَمَا أُخِذَ مِنْ أَعْطَانِهِ فَفِيهِ الْقَطْعُ إِذَا بَلَغَ مَا يُؤْخَذُ مِنْ ذَلِكَ ثَمَنَ الْمِجَنِّ فَسَأَلَهُ فَقَالَ يَا رَسُولَ اللَّهِ اللُّقَطَةُ نَجِدُهَا فِي السَّبِيلِ الْعَامِرِ قَالَ عَرِّفْهَا سَنَةً فَإِنْ جَاءَ صَاحِبُهَا وَإِلَّا فَهِيَ لَكَ قَالَ يَا رَسُولَ اللَّهِ مَا يُوجَدُ فِي الْخَرَابِ الْعَادِيِّ قَالَ فِيهِ وَفِي الرِّكَازِ الْخُمُسُ.
انگریزی ترجمہ
Ibn Idris narrated to us: I heard Ibn Ishaq from Amr ibn Shu'ayb from his father from his grandfather who said: I heard the Messenger of Allah (peace be upon him) while a man from Muzaynah was asking him about stray camels. He said: "They have their hooves and their water supply. They eat the trees and come to the watering places. Leave them until their owner finds them." He asked about stray sheep. He said: "They are for you, or for your brother, or for the wolf. Gather them until their owner comes." He asked about fruit in its husks. He said: "Whoever eats out of need and does not take away a portion in his garment, there is nothing against him. Whoever carries away, he is fined twice its value and punished. Whoever steals after it has been gathered into the drying area, and it reaches the value of a shield, amputation is applied."
