حَدَّثَنَا وَكِيعٌ قَالَ حَدَّثَنَا هِشَامٌ عَنْ أَبِيهِ عَنْ عَائِشَةَ أَنَّ بَرِيرَةَ أَتَتْهَا وَهِيَ مُكَاتَبَةٌ قَدْ كَاتَبَهَا أَهْلُهَا عَلَى تِسْعِ أَوَاقٍ فَقَالَتْ لَهَا إِنْ شَاءَ أَهْلُكِ عَدَدْتُهَا لَهُمْ عَدَّةً وَاحِدَةً وَكَانَ الْوَلَاءُ لِي فَأَتَتْ أَهْلَهَا فَذَكَرَتْ ذَلِكَ لَهُمْ وَأَبَوْا إِلَّا أَنْ يَشْتَرِطُوا الْوَلَاءَ لَهُمْ فَذَكَرَتْهُ عَائِشَةُ لِلنَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَقَالَ افْعَلِي فَفَعَلَتْ فَقَامَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَخَطَبَ النَّاسَ فَحَمِدَ اللَّهَ وَأَثْنَى عَلَيْهِ قَالَ مَا بَالُ رِجَالٍ يَشْتَرِطُونَ شُرُوطًا لَيْسَتْ فِي كِتَابِ اللَّهِ قَالَ كُلُّ شَرْطٍ لَيْسَ فِي كِتَابِ اللَّهِ فَهُوَ بَاطِلٌ كِتَابُ اللَّهِ أَحَقُّ وَشَرْطُهُ أَوْثَقُ وَالْوَلَاءُ لِمَنْ أَعْتَقَ.
انگریزی ترجمہ
Aisha reported that Barirah came to her while she was a mukataba (a slave with a contract for freedom). Her masters had written her freedom contract for nine uqiyyas. Aisha said to her: "If your masters wish, I will pay them the full amount at once, and the wala' (patronage) will be mine." She went to her masters and told them, but they refused unless the wala' would be theirs. Aisha mentioned that to the Prophet (peace be upon him), and he said: "Do it." She did, and the Prophet stood and addressed the people, praising and glorifying Allah, then said: "What is the matter with people who stipulate conditions that are not in the Book of Allah? Every condition that is not in the Book of Allah is invalid. The Book of Allah is more deserving and His condition is more binding. The wala' belongs to the one who frees (the slave)."
