حَدَّثَنَا إِسْحَاقُ بْنُ عِيسَى قَالَ حَدَّثَنِي لَيْثٌ قَالَ حَدَّثَنِي ابْنُ شِهَابٍ عَنْ عُرْوَةَ عَنْ عَائِشَةَ أَنَّ بَرِيرَةَ جَاءَتْ عَائِشَةَ تَسْتَعِينُهَا فِي كِتَابَتِهَا وَلَمْ تَكُنْ قَضَتْ مِنْ كِتَابَتِهَا شَيْئًا فَقَالَتْ لَهَا عَائِشَةُ ارْجِعِي إِلَى أَهْلِكِ فَإِنْ أَحَبُّوا أَنْ أَقْضِيَ عَنْكِ كِتَابَتَكِ وَيَكُونَ وَلَاؤُكِ لِي فَعَلْتُ فَذَكَرَتْ ذَلِكَ بَرِيرَةُ لِأَهْلِهَا فَأَبَوْا وَقَالُوا إِنْ شَاءَتْ أَنْ تَحْتَسِبَ عَلَيْكِ فَلْتَفْعَلْ وَلْيَكُنْ لَنَا وَلَاؤُكِ فَذَكَرْتُ ذَلِكَ لِرَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ابْتَاعِي فَأَعْتِقِي فَإِنَّمَا الْوَلَاءُ لِمَنْ أَعْتَقَ قَالَتْ ثُمَّ قَامَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَقَالَ مَا بَالُ أُنَاسٍ يَشْتَرِطُونَ شُرُوطًا لَيْسَتْ فِي كِتَابِ اللَّهِ عَزَّ وَجَلَّ مَنْ اشْتَرَطَ شَرْطًا لَيْسَ فِي كِتَابِ اللَّهِ عَزَّ وَجَلَّ فَلَيْسَ لَهُ وَإِنْ شَرَطَ مِائَةَ مَرَّةٍ شَرْطُ اللَّهِ عَزَّ وَجَلَّ أَحَقُّ وَأَوْثَقُ.
انگریزی ترجمہ
Ishaq ibn Isa told us: Layth told me: Ibn Shihab told me, from Urwah, from A'isha, that Barirah came to A'isha seeking her help regarding her contract of manumission, and she had not yet paid off anything of it. A'isha said to her: "Go back to your masters; if they agree that I pay off your contract for you and your right of inheritance (wala') be mine, I will do so." Barirah mentioned that to her masters, but they refused, saying: "If she wants to do you a favor, let her, but the wala' shall be ours." So I mentioned that to the Messenger of Allah, peace and blessings be upon him, and the Messenger of Allah, peace and blessings be upon him, said: "Buy her and set her free, for the wala' belongs to the one who frees the slave." Then the Messenger of Allah, peace and blessings be upon him, stood up and said: "What is the matter with people who stipulate conditions that are not in the Book of Allah, Mighty and Sublime? Whoever stipulates a condition that is not in the Book of Allah, Mighty and Sublime, it is not valid for him, even if he stipulates it a hundred times. The condition of Allah, Mighty and Sublime, is more deserving and more binding."
