حَدَّثَنَا يَعْقُوبُ قَالَ حَدَّثَنَا أَبِي عَنِ ابْنِ إِسْحَاقَ قَالَ حَدَّثَنِي سَعِيدُ بْنُ أَبِي سَعِيدٍ الْمَقْبُرِيُّ عَنْ أَبِي شُرَيْحٍ الْخُزَاعِيِّ قَالَ لَمَّا بَعَثَ عَمْرُو بْنُ سَعِيدٍ إِلَى مَكَّةَ بَعْثَهُ يَغْزُو ابْنَ الزُّبَيْرِ أَتَاهُ أَبُو شُرَيْحٍ فَكَلَّمَهُ وَأَخْبَرَهُ بِمَا سَمِعَ مِنْ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ثُمَّ خَرَجَ إِلَى نَادِي قَوْمِهِ فَجَلَسَ فِيهِ فَقُمْتُ إِلَيْهِ فَجَلَسْتُ مَعَهُ فَحَدَّثَ قَوْمَهُ كَمَا حَدَّثَ عَمْرَو بْنَ سَعِيدٍ مَا سَمِعَ مِنْ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَعَمَّا قَالَ لَهُ عَمْرُو بْنُ سَعِيدٍ قَالَ قُلْتُ هَذَا إِنَّا كُنَّا مَعَ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ حِينَ افْتَتَحَ مَكَّةَ فَلَمَّا كَانَ الْغَدُ مِنْ يَوْمِ الْفَتْحِ عَدَتْ خُزَاعَةُ عَلَى رَجُلٍ مِنْ هُذَيْلٍ فَقَتَلُوهُ وَهُوَ مُشْرِكٌ فَقَامَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِينَا خَطِيبًا فَقَالَ يَا أَيُّهَا النَّاسُ إِنَّ اللَّهَ عَزَّ وَجَلَّ حَرَّمَ مَكَّةَ يَوْمَ خَلَقَ السَّمَاوَاتِ وَالْأَرْضَ فَهِيَ حَرَامٌ مِنْ حَرَامِ اللَّهِ تَعَالَى إِلَى يَوْمِ الْقِيَامَةِ لَا يَحِلُّ لِامْرِئٍ يُؤْمِنُ بِاللَّهِ وَالْيَوْمِ الْآخِرِ أَنْ يَسْفِكَ فِيهَا دَمًا وَلَا يَعْضِدَ بِهَا شَجَرًا لَمْ تَحْلِلْ لِأَحَدٍ كَانَ قَبْلِي وَلَا تَحِلُّ لِأَحَدٍ يَكُونُ بَعْدِي وَلَمْ تَحْلِلْ لِي إِلَّا هَذِهِ السَّاعَةَ غَضَبًا عَلَى أَهْلِهَا أَلَا ثُمَّ قَدْ رَجَعَتْ كَحُرْمَتِهَا بِالْأَمْسِ أَلَا فَلْيُبَلِّغْ الشَّاهِدُ مِنْكُمْ الْغَائِبَ فَمَنْ قَالَ لَكُمْ إِنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَدْ قَاتَلَ بِهَا فَقُولُوا إِنَّ اللَّهَ عَزَّ وَجَلَّ قَدْ أَحَلَّهَا لِرَسُولِهِ وَلَمْ يُحْلِلْهَا لَكُمْ يَا مَعْشَرَ خُزَاعَةَ وَارْفَعُوا أَيْدِيَكُمْ عَنْ الْقَتْلِ فَقَدْ كَثُرَ أَنْ يَقَعَ لَئِنْ قَتَلْتُمْ قَتِيلًا لَأَدِيَنَّهُ فَمَنْ قُتِلَ بَعْدَ مَقَامِي هَذَا فَأَهْلُهُ بِخَيْرِ النَّظَرَيْنِ إِنْ شَاءُوا فَدَمُ قَاتِلِهِ وَإِنْ شَاءُوا فَعَقْلُهُ ثُمَّ وَدَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ الرَّجُلَ الَّذِي قَتَلَتْهُ خُزَاعَةُ فَقَالَ عَمْرُو بْنُ سَعِيدٍ لِأَبِي شُرَيْحٍ انْصَرِفْ أَيُّهَا الشَّيْخُ فَنَحْنُ أَعْلَمُ بِحُرْمَتِهَا مِنْكَ إِنَّهَا لَا تَمْنَعُ سَافِكَ دَمٍ وَلَا خَالِعَ طَاعَةٍ وَلَا مَانِعَ جِزْيَةٍ قَالَ فَقُلْتُ قَدْ كُنْتُ شَاهِدًا وَكُنْتَ غَائِبًا وَقَدْ بَلَّغْتُ وَقَدْ أَمَرَنَا رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَنْ يُبَلِّغَ شَاهِدُنَا غَائِبَنَا وَقَدْ بَلَّغْتُكَ فَأَنْتَ وَشَأْنُكَ.

Ya'qub told us: my father told us, from Ibn Ishaq, who said: Sa'id ibn Abi Sa'id al-Maqburi told me, from Abu Shurayh al-Khuza'i, who said: When Amr ibn Sa'id sent an expedition to Mecca to fight Ibn al-Zubayr, Abu Shurayh came to him and spoke to him and informed him of what he had heard from the Messenger of Allah, peace and blessings be upon him. Then he went out to the gathering place of his people and sat there, and I went to him and sat with him. He told his people, as he had told Amr ibn Sa'id, what he had heard from the Messenger of Allah, peace and blessings be upon him, and what Amr ibn Sa'id had said to him. He said: I said this: We were with the Messenger of Allah, peace and blessings be upon him, when he conquered Mecca. On the day after the Conquest, Khuza'a attacked a man of Hudhayl and killed him, while he was a polytheist. The Messenger of Allah, peace and blessings be upon him, stood among us delivering a sermon and said: "O people, Allah, Mighty and Majestic, made Mecca sacred on the day He created the heavens and the earth. So it is sacred, part of Allah's sanctity, until the Day of Resurrection. It is not lawful for a man who believes in Allah and the Last Day to shed blood in it, or to cut down a tree in it. It was not made lawful for anyone before me, and it will not be made lawful for anyone after me, and it was not made lawful for me except for this hour, out of anger against its people. Then indeed its sanctity has returned as it was yesterday. Let those present among you convey this to those absent. Whoever tells you that the Messenger of Allah, peace and blessings be upon him, fought in it, say: Allah, Mighty and Majestic, made it lawful for His Messenger, and He did not make it lawful for you, O company of Khuza'a. So withhold your hands from killing, for it has become too frequent. If you kill anyone, I will surely pay his blood money. Whoever is killed after this stand of mine, then his family has the choice of the two best options: if they wish, the blood of his killer, or if they wish, his blood money." Then the Messenger of Allah, peace and blessings be upon him, paid the blood money for the man whom Khuza'a had killed. Amr ibn Sa'id said to Abu Shurayh: "Go away, O old man. We know its sanctity better than you. It does not protect a shedder of blood, nor one who has thrown off obedience, nor one who withholds the jizya." He said: I said: "I was present and you were absent. I have conveyed it, and the Messenger of Allah, peace and blessings be upon him, commanded us that those present among us should convey it to those absent. I have conveyed it to you, so it is now your affair."
