Ḥadīth | Ṭabarānī (الطبراني) tabarani:10830 حَدَّثَنَا عَلِيُّ بْنُ عَبْدِ الْعَزِيزِ ثنا حَجَّاجُ بْنُ الْمِنْهَالِ ح وَحَدَّثَنَا مُحَمَّدُ بْنُ مُعَاذٍ الْحَلَبِيُّ ثنا عَبْدُ اللهِ بْنُ رَجَاءٍ قَالَا ثنا جَرِيرُ بْنُ حَازِمٍ حَدَّثَنِي قَيْسُ بْنُ سَعْدٍ عَنْ يَزِيدَ بْنِ هُرْمُزَ قَالَ سَمِعْتُ ابْنَ عَبَّاسٍ وَأَتَاهُ كِتَابُ نَجْدَةَ كَتَبَ إِلَيْهِ يَسْأَلُهُ عَنْ ذِي الْقُرْبَى الَّذِينَ ذَكَرَ اللهُ فِي الْقُرْآنِ وَعَنْ قَتْلِ أَوْلَادِ الْمُشْرِكِينَ وَهَلْ كَانَ النَّبِيُّ ﷺ يَقْتُلُهُمْ؟ وَعَنِ انْقِضَاءِ يُتْمِ الْيَتِيمِ وَعَنِ الْعَبْدِ وَالْمَرْأَةِ يَشْهَدَانِ الْبَأْسَ فَقَالَ لَوْلَا أَنْ أَرُدَّهُ عَنْ شَرٍّ أَخَافُ أَنْ يَقَعَ فِيهِ مَا كَتَبْتُ إِلَيْهِ فَكَتَبَ فِي ذَوِي الْقُرْبَى إِنَّا كُنَّا نَرَى قَرَابَةَ رَسُولِ اللهِ ﷺ هُمْ فَأَبَى عَلَيْنَا قَوْمُنَا ذَلِكَ وَأَمَّا الْيَتِيمُ فَإِذَا بَلَغَ النِّكَاحَ وَأُونِسَ مِنْهُمْ رَشَدٌ دُفِعَ إِلَيْهِ مَالُهُ فَقَدِ انْقَضَى يُتْمُهُ وَأَمَّا الصِّبْيَانُ فَإِنَّ رَسُولَ اللهِ ﷺ لَمْ يَكُنْ يَقْتُلُ أَوْلَادَ الْمُشْرِكِينَ وَأَنْتَ فَلَا تَقْتُلْهُمْ إِلَّا أَنْ تَكُونَ تَعْلَمُ مِثْلَ مَا عَلِمَ الْخَضِرُ مِنِ الْغُلَامِ حِينَ قَتَلَهُ وَفِي الْعَبْدِ وَالْمَرْأَةِ هَلْ لَهُمَا سَهْمٌ إِذَا شَهِدَا الْبَأْسَ؟ فَكَتَبَ إِلَيْهِ أَنَّهُ لَيْسَ لَهُمَا سَهْمٌ مَعْلُومٌ إِلَّا أَنْ يُحْذَيَا مِنْ غَنَائِمِ الْقَوْمِ
English Translation
Ibn Abbas narrated that Najdah wrote to him asking about the near relatives mentioned by Allah in the Quran, about killing the children of the polytheists, whether the Prophet (peace be upon him) used to kill them, about when an orphan's orphanhood ends, and about whether a slave and a woman who participate in battle receive a share. He wrote: 'Were it not that I fear he might fall into something worse, I would not have written to him.' He wrote regarding the near relatives: 'We used to consider ourselves the relatives of the Messenger of Allah (peace be upon him), but our people refused us that.' Regarding the orphan: 'When he reaches the age of marriage and soundness of judgment is recognized in him, his property is given to him, and his orphanhood has ended.' Regarding children: 'The Messenger of Allah (peace be upon him) did not kill the children of the polytheists. You too should not kill them, unless you know what al-Khidr knew about the boy when he killed him.' Regarding the slave and woman: 'They have no fixed share, but they may be given a gift from the spoils.'
