نا هُشَيْمٌ، قَالَ: أنا يُونُسُ، عَنِ ابْنِ سِيرِينَ، قَالَ: كَانَ يَقُولُ:"يُنْفَقُ عَلَيْهَا مِنْ جَمِيعِ الْمَالِ". قَالَ: كَانَ ذَلِكَ رَأْيَهُ، حَتَّى وَلِيَ تَرِكَةَ ابْنِ أَخٍ لَهُ , تَرَكَ أُمَّ وَلَدٍ لَهُ وَهِيَ حَامِلٌ , فَكَرِهَ أَنْ يَعْمَلَ فِيهَا بِرَأْيِهِ , فَأَرْسَلَ إِلَى عَبْدِ الْمَلِكِ بْنِ يَعْلَى قَاضِي الْبَصْرَةِ، فَسَأَلَهُ عَنْ ذَلِكَ، فَقَالَ:" لا نَفَقَةَ لَهَا".
English Translation
Ibn Sirin used to hold the opinion that the umm al-walad's maintenance should come from the entire estate, until he was put in charge of the estate of a nephew who left behind a pregnant umm al-walad. He disliked acting on his own opinion, so he asked Abd al-Malik ibn Ya'la, the judge of Basra, who said: "She has no right to maintenance."
