English Translation
Narrated Umm al-Mu'minin A'ishah al-Siddiqah (may Allah be pleased with her): Barirah came to me and said: My masters have made a contract of emancipation (mukatabah) with me for nine uqiyah, one uqiyah each year, so help me. I said: If your masters are agreeable, I will pay this whole sum at once and free you, but I will have your right of patronage (wala'). Barirah (may Allah be pleased with her) mentioned this to her masters, but they refused and said: We will take the wala'. Then Barirah came to me and reported this, so I rebuked her. She said: By Allah, this will not happen. Umm al-Mu'minin A'ishah al-Siddiqah (may Allah be pleased with her) said: The Messenger of Allah (peace be upon him) heard this and asked me, and when I related the whole matter to him, he (peace be upon him) said: "Buy her and free her, and let them stipulate the wala' for themselves, for the wala' belongs only to the one who frees." So I did just that. After this, the Messenger of Allah (peace be upon him) delivered a sermon in the evening, praised and glorified Allah the Exalted as He deserves, and then said: "What is the matter with people who make conditions that are not in the Book of Allah the Exalted? Any condition that is not in the Book of Allah the Exalted is invalid, even if it be stipulated a hundred times. The Book of Allah the Exalted is more deserving, and the condition of Allah is stronger. The state of some of you is that they say to another: Free (the slave or slave-girl), and we will take the wala' — whereas the wala' belongs only to the one who frees." ام المؤمنین عائشہ صدیقہ رضی اللہ عنہا کہتی ہیں کہبریرہ میرے پاس آئی اور کہا کہ میرے مالکوں نے میرے ساتھ نو اوقیہ پر مکاتبت کی ہے، ہر برس میں ایک اوقیہ۔ پس تم میری مدد کرو۔ میں نے کہا کہ اگر تمہارے مالک راضی ہوں تو میں یہ ساری رقم یکمشت دے دیتی ہوں اور تمہیں آزاد کر دیتی ہوں، لیکن تمہاری ولاء میں لوں گی۔ سیدہ بریرہ رضی اللہ عنہا نے اس کا ذکر اپنے مالکوں سے کیا تو انہوں نے نہ مانا اور یہ کہا کہ ولاء ہم لیں گے۔ پھر بریرہ میرے پاس آئی اور یہ بیان کیا تو میں نے اس کو جھڑکا، اس نے کہا اللہ کی قسم یہ نہ ہو گا۔ ام المؤمنین عائشہ صدیقہ رضی اللہ عنہا نے کہا کہ یہ رسول اللہصلی اللہ علیہ وسلمنے سن لیا اور مجھ سے پوچھا، تو میرے سب حال بیان کرنے پر آپصلی اللہ علیہ وسلمنے فرمایا: تو خرید لے اور آزاد کر دے اور ولاء کی شرط انہی کے لئے کر لے کیونکہ ولاء اسی کو ملے گی جو آزاد کرے گا۔ میں نے ایسا ہی کیا اس کے بعد رسول اللہصلی اللہ علیہ وسلمنے شام کو خطبہ پڑھا اور اللہ تعالیٰ کی حمد و ثناء بیان کی جیسے اس کو لائق ہے، پھر اس کے بعد فرمایا کہ لوگوں کا کیا حال ہے کہ وہ وہ شرطیں لگاتے ہیں جو اللہ تعالیٰ کی کتاب میں نہیں ہیں۔ جو شرط اللہ تعالیٰ کی کتاب میں نہیں ہے وہ باطل ہے اگرچہ سو بار شرط کی گئی ہو۔ اللہ تعالیٰ کی کتاب زیادہ حقدار ہے اور اللہ کی شرط مضبوط ہے۔ تم میں سے بعض لوگوں کا یہ حال ہے کہ دوسرے سے کہتے ہیں کہ تم (غلام یا باندی کو) آزاد کرو اور ولاء ہم لیں گے حالانکہ ولاء اسی کو ملے گی جو آزاد کرے گا۔[مختصر صحيح مسلم/حدیث: 896]
