English Translation
Abu Hurayrah (may Allah be pleased with him) narrates from the Prophet (peace be upon him) that he said: "Two women were going along, each carrying her child, when a wolf came and carried off the child of one of them. One said to the other: 'It carried off your son.' And the other said: 'It carried off your son.' In the end they both came to Dawud (peace be upon him) to have their case decided. He awarded the child to the older woman (because the child would resemble her, or in their law the elder was given preference in such a case, or the child was in her hand). Then the two of them came to Sulayman (peace be upon him) and told him the whole matter. He said: 'Bring a knife, and we will cut the child into two pieces and give one to each of you.' (His purpose was not to cut the child, but to discover the real mother.) So the younger one said: 'May Allah have mercy on you, do not do it; he is the son of the older woman.' Sulayman (peace be upon him) awarded the child to the younger one (so Sulayman, peace be upon him, ruled contrary to Dawud, peace be upon him, because both were qualified in independent legal reasoning (ijtihad) and both were prophets, and it is permissible for one such scholar to differ from another. In matters of ijtihad it is not permissible to overturn any ruling, but perhaps Dawud, peace be upon him, had not made his ruling final, or it was merely by way of a legal opinion)." Abu Hurayrah (may Allah be pleased with him) said: "In this hadith it was on that day that I first heard the word 'sikkin' for what is called a knife, otherwise we used to say 'mudyah.'" Urdu Translation
سیدنا ابوہریرہ رضی اللہ عنہ نبی کریمصلی اللہ علیہ وسلمسے روایت کرتے ہیں کہآپصلی اللہ علیہ وسلمنے فرمایا کہ دو عورتیں اپنے اپنے بچے لئے جا رہی تھیں کہ اتنے میں بھیڑیا آیا اور ایک کا بچہ لے گیا۔ ایک نے دوسری سے کہا کہ تیرا بیٹا لے گیا۔ اور دوسری نے کہا کہ تیرا بیٹا لے گیا ہے۔ آخر دونوں اپنا فیصلہ کرانے کو سیدنا داؤد علیہ السلام کے پاس آئیں۔ انہوں نے بچہ بڑی عورت کو دلا دیا (اس وجہ سے کہ بچہ اس کے مشابہ ہو گا یا ان کی شریعت میں ایسی صورت میں بڑے کو ترجیح ہو گی یا بچہ اس کے ہاتھ میں ہو گا)۔ پھر وہ دونوں سیدنا سلیمان علیہ السلام کے پاس آئیں اور ان سے سب حال بیان کیا۔ انہوں نے کہا کہ چھری لاؤ ہم بچے کے دو ٹکڑے کر کے تم دونوں کو دیدیں گے (اس سے بچے کا کاٹنا مقصود نہ تھا بلکہ حقیقی ماں کا دریافت کرنا منظور تھا)، تو چھوٹی نے کہا کہ اللہ تعالیٰ تجھ پر رحم کرے ایسا مت کر وہ بڑی کا بیٹا ہے۔ سیدنا سلیمان علیہ السلام نے وہ بچہ چھوٹی کو دلا دیا (تو سیدنا سلیمان علیہ السلام نے سیدنا داؤد علیہ السلام کے خلاف حکم دیا، اس لئے کہ دونوں مجتہد تھے اور پیغمبر بھی تھے اور مجتہد کو دوسرے مجتہد کا خلاف درست ہے۔ مسائل اجتہادی میں کوئی حکم توڑنا درست نہیں مگر شاید سیدنا داؤد علیہ السلام نے اس فیصلہ کو قطع نہ کیا ہو گا یا صرف بطور فتویٰ کے ہو گا) سیدنا ابوہریرہ رضی اللہ عنہ نے کہا کہ اس حدیث میں میں نے اسی دن سکین کا لفظ سنا ہے جو چھری کو کہتے ہیں ورنہ ہم تو مدیہ کہا کرتے تھے۔[مختصر صحيح مسلم/حدیث: 1057]
