حَدَّثَنَا أَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ، حَدَّثَنَا عَبْدُ الرَّحْمَنِ بْنُ مَهْدِيٍّ، عَنْ سُفْيَانَ، عَنْ فِرَاسٍ، عَنِ الشَّعْبِيِّ، عَنْ مَسْرُوقٍ، عَنْ عَبْدِ اللَّهِ، أَنَّهُ سُئِلَ عَنْ رَجُلٍ، تَزَوَّجَ امْرَأَةً فَمَاتَ عَنْهَا وَلَمْ يَدْخُلْ بِهَا وَلَمْ يَفْرِضْ لَهَا . قَالَ فَقَالَ عَبْدُ اللَّهِ لَهَا الصَّدَاقُ وَلَهَا الْمِيرَاثُ وَعَلَيْهَا الْعِدَّةُ . فَقَالَ مَعْقِلُ بْنُ سِنَانٍ الأَشْجَعِيُّ شَهِدْتُ رَسُولَ اللَّهِ ـ صلى الله عليه وسلم ـ قَضَى فِي بَرْوَعَ بِنْتِ وَاشِقٍ بِمِثْلِ ذَلِكَ . حَدَّثَنَا أَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ، حَدَّثَنَا عَبْدُ الرَّحْمَنِ بْنُ مَهْدِيٍّ، عَنْ سُفْيَانَ، عَنْ مَنْصُورٍ، عَنْ إِبْرَاهِيمَ، عَنْ عَلْقَمَةَ، عَنْ عَبْدِ اللَّهِ، مِثْلَهُ .
English Translation
It is narrated from Hadrat Masruq (may Allah be well pleased with him) that:Hadrat Abdullah was asked about a man who married a woman and died without having consummated the marriage with her, nor stipulating the dowry. Hadrat Abdullah said: “The dowry is hers, and the inheritance is hers and she has to observe the waiting period.” Ma'qil bin Sinan Al-Ashja'i said: “I saw the Beloved Messenger of Allah (blessings and peace of Allah be upon him) pass a similar ruling concerning Birwa' bint Washiq.” (Sahih) Another chain from 'Alqamah, from Hadrat Abdullah, with similar wording. Urdu Translation
حضرت عبداللہ بن مسعود رضی اللہ تعالیٰ عنہ سے روایت ہے کہ ان سے ایک ایسے شخص کے بارے میں پوچھا گیا جس نے کسی عورت سے شادی کی، اور مہر کی تعین اور دخول سے پہلے ہی اس کا انتقال ہو گیا، تو انہوں نے کہا: اس عورت کو مہر ملے گا، اور میراث سے حصہ ملے گا، اور اس پہ عدت بھی لازم ہو گی، تو معقل بن سنان اشجعی رضی اللہ تعالیٰ عنہ نے کہا: میں رسول اللہ صلی اللہ تعالیٰ علیہ وآلہ وسلم کے پاس موجود تھا، جب آپ نے بروع بنت واشق رضی اللہ تعالیٰ عنہا کے سلسلہ میں ایسے ہی فیصلہ کیا ۱؎۔
