حَدَّثَنَامُحَمَّدُ بْنُ يَحْيَى، قَالَ: ثناعَمْرُو بْنُ حَمَّادِ بْنِ طَلْحَةَ، قَالَ: ثناأَسْبَاطٌ يَعْنِي ابْنَ نَصْرٍ، عَنْسِمَاكٍ، عَنْعَلْقَمَةَ بْنِ وَائِلٍ، عَنْ أَبِيهِوَائِلِ بْنِ حُجْرٍرَضِيَ اللَّهُ عَنْهُ، أَنَّ امْرَأَةً وَقَعَ عَلَيْهَا رَجُلٌ فِي سَوَادِ الصُّبْحِ وَهِيَ تَعْمِدَ إِلَى الْمَسْجِدِ عَنْ كُرْهٍ، قَالَ ابْنُ يَحْيَى: مُكَابَدَةً عَلَى نَفْسِهَا، فَاسْتَعَانَتْ بِرَجُلٍ مَرَّ عَلَيْهَا وَفَرَّ صَاحِبُهَا، ثُمَّ مَرَّ عَلَيْهَا قَوْمٌ دُونَ عَدَدٍ فَاسْتَعَانَتْ بِهِمْ فَأَدْرَكُوا الَّذِي اسْتَعَانَتْ بِهِ وَسَبِقَهُمُ الآخَرُ فَذَهَبَ فَجَاءُوا بِهِ يَقُودُونَهُ إِلَيْهَا، فَقَالَ: إِنَّمَا أَنَا الَّذِي أَعَنْتُكِ، وَقَدْ ذَهَبَ الآخَرُ، فَأَتَوْا بِهِ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَأَخْبَرَتْهُ أَنَّهُ وَقَعَ عَلَيْهَا وَأَخْبَرَهُ الْقَوْمُ أَنَّهُمْ أَدْرَكُوهُ يَشْتَدُّ، فَقَالَ: إِنَّمَا كُنْتُ أُعْيِنُهَا عَلَى صَاحِبِهَا، فَأَدْرَكَنِي هَؤُلاءِ فَأَخَذُونِي، فَقَالَتْ: كَذَبَ هُوَ الَّذِي وَقَعَ عَلَيَّ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ:" اذْهَبُوا بِهِ فَارْجُمُوهُ، قَالَ: فَقَامَ رَجُلٌ مِنَ النَّاسِ، فَقَالَ: لا تَرْجُمُوهُ وَارْجُمُونِي، أَنَا الَّذِي فَعَلْتُ بِهَا الْفِعْلَ، فَاعْتَرَفَ، فَاجْتَمَعَ ثَلاثَةٌ عِنْدَ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ الَّذِي وَقَعَ عَلَيْهَا وَالَّذِي أَعَانَهَا وَالْمَرْأَةُ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: أَمَّا أَنْتَ فَقَدْ غَفَرَ اللَّهُ لَكَ، وَقَالَ لِلَّذِي أَعَانَهَا قَوْلا حَسَنًا، قَالَ عُمَرُ رَضِيَ اللَّهُ عَنْهُ: أَرْجُمُ الَّذِي اعْتَرَفَ بِالزِّنَا؟ قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: لا إِنَّهُ قَدْ تَابَ إِلَى اللَّهِ"، فَقَالَ ابْنُ عُمَيْرٍ: زَادَ فِيهَا لَوْ تَابَهَا أَهْلُ الْمَدِينَةِ أَوْ أَهْلُ يَثْرِبَ لَقُبِلَ مِنْهُمْ، فَأَرْسَلَهُمْ، قَالَ ابْنُ يَحْيَى: يُرِيدُ بِهِ عُبَيْدَ بْنَ عُمَيْرٍ.
English Translation
Narrated Wa'il ibn Hujr (may Allah be pleased with him): A man assaulted a woman in the darkness before dawn as she was heading to the mosque, forcing himself upon her. She cried out for help to a man who passed by, and the assailant fled. Then a group of people passed by and she sought their help. They caught the man she had called for help, while the actual perpetrator had escaped. They brought him to her, and he said: I am the one who helped you — the other man has fled. They brought him to the Messenger of Allah (peace and blessings of Allah be upon him). She told him that the man had assaulted her, and the people said they had caught him running. He said: I was only helping her against her attacker, and these people caught me. She said: He is lying — he is the one who assaulted me. The Messenger of Allah (peace and blessings of Allah be upon him) said: "Take him and stone him." Then a man from among the people stood up and said: Do not stone him — stone me instead! I am the one who did it. He confessed. So three people were gathered before the Messenger of Allah: the actual perpetrator, the one who had helped her, and the woman. The Messenger of Allah (peace and blessings of Allah be upon him) said to the woman: "As for you, Allah has forgiven you." He said kind words to the one who had helped her. Umar said: Shall we stone the one who confessed to adultery? The Messenger of Allah (peace and blessings of Allah be upon him) said: "No, for he has repented to Allah." Ibn Umayr added: He repented with such a repentance that if the people of Madinah were to repent like that, it would be accepted from them. Then he released them all.
