Arabic (Original)
حَدَّثَنَا خَلاَّدُ بْنُ يَحْيَى، حَدَّثَنَا نَافِعُ بْنُ عُمَرَ، عَنِ ابْنِ أَبِي مُلَيْكَةَ، قَالَ كَتَبْتُ إِلَى ابْنِ عَبَّاسٍ فَكَتَبَ إِلَىَّ أَنَّ النَّبِيَّ صلى الله عليه وسلم قَضَى أَنَّ الْيَمِينَ عَلَى الْمُدَّعَى عَلَيْهِ.
English Translation
It is narrated by Ibn Abu Mulaika who said: I wrote a letter to Hadrat Abdullah bin Abbas (may Allah be well pleased with them both) and he wrote back to me that the Noble Prophet (blessings and peace of Allah be upon him) had ruled that (if the claimant cannot produce witnesses, then) the oath shall be upon the defendant.
Urdu Translation
حضرت ابن ابی ملیکہ سے روایت ہے، انہوں نے فرمایا: میں نے حضرت عبداللہ بن عباس رضی اللہ تعالیٰ عنہما کو خط لکھا تو انہوں نے جواب میں تحریر فرمایا کہ نبی کریم صلی اللہ تعالیٰ علیہ وآلہ وسلم نے یہ فیصلہ فرمایا تھا کہ (اگر مدعی گواہ نہ پیش کر سکے تو) مدعیٰ علیہ سے قسم لی جائے گی۔
