حَدَّثَنَا أَحْمَدُ بْنُ عَبْدَةَ نَا سُفْيَانُ بْنُ عُيَيْنَةَ عَنِ الزُّهْرِيِّ عَنْ عُبَيْدِ اللَّهِ عَنْ أَبِي هُرَيْرَةَ وَزَيْدِ بْنِ خَالِدٍ وَشِبْلٍ رَضِيَ اللَّهُ عَنْهُمْ قَالُوا كُنَّا عِنْدَ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَقَامَ إِلَيْهِ رَجُلُ وَقَالَ أَنْشُدُكَ اللَّهُ أَلَا قَضَيْتَ بَيْنَنَا بِكِتَابِ اللَّهِ فَقَامَ خَصْمُهُ وَكَانَ أَفْقَهَ مِنْهُ فَقَالَ أَجَلْ فَاقْضِ بَيْنَنَا بِكِتَابِ اللَّهِ وَائذَنْ لِي فَأَتَكَلَّمَ قَالَ قُلْ قَالَ إِنَّ ابْنِي كَانَ عَسِيفًا عَلَى هَذَا فَزَنَى بِامْرَأَتِهِ فَأُخْبِرْتُ أَنَّ عَلَى ابْنِي الرَّجْمَ فَافْتَدَيْتُ مِنْهُ بِمِائَةِ شَاةٍ وَخَادِمٍ ثُمَّ سَأَلْتُ رِجَالًا مِنْ أَهْلِ الْعِلْمِ فَأَخْبَرُونِي أَنَّ عَلَى ابْنِي جَلْدَ مِائَةٍ وَتَغْرِيبَ عَامٍ وَأَنَّ عَلَى امْرَأَةِ هَذَا الرَّجْمُ فَقَالَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَالَّذِي نَفْسِي بِيَدِهِ لَأَقْضِيَنَّ بَيْنَكُمَا بِكِتَابِ اللَّهِ الْمِائَةُ شَاةٍ وَالْخَادِمُ رَدٌّ عَلَيْكَ وَعَلَى ابْنِكَ جَلْدُ مِائَةٍ وَتَغْرِيبُ عَامٍ وَاغْدُ أَنْتَ يَا أُنَيْسُ عَلَى امْرَأَةِ هَذَا فَإِنِ اعْتَرَفَتْ فَارْجُمْهَا فَغَدَا عَلَيْهَا فَاعْتَرَفَتْ فَرَجَمَهَا رَضِيَ اللَّهُ عَنْهُمْ قَالُوا كُنَّا عِنْدَ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَقَامَ إِلَيْهِ رَجُلُ وَقَالَ أَنْشُدُكَ اللَّهُ أَلَا قَضَيْتَ بَيْنَنَا بِكِتَابِ اللَّهِ فَقَامَ خَصْمُهُ وَكَانَ أَفْقَهَ مِنْهُ فَقَالَ أَجَلْ فَاقْضِ بَيْنَنَا بِكِتَابِ اللَّهِ وَائذَنْ لِي فَأَتَكَلَّمَ قَالَ قُلْ قَالَ إِنَّ ابْنِي كَانَ عَسِيفًا عَلَى هَذَا فَزَنَى بِامْرَأَتِهِ فَأُخْبِرْتُ أَنَّ عَلَى ابْنِي الرَّجْمَ فَافْتَدَيْتُ مِنْهُ بِمِائَةِ شَاةٍ وَخَادِمٍ ثُمَّ سَأَلْتُ رِجَالًا مِنْ أَهْلِ الْعِلْمِ فَأَخْبَرُونِي أَنَّ عَلَى ابْنِي جَلْدَ مِائَةٍ وَتَغْرِيبَ عَامٍ وَأَنَّ عَلَى امْرَأَةِ هَذَا الرَّجْمُ فَقَالَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَالَّذِي نَفْسِي بِيَدِهِ لَأَقْضِيَنَّ بَيْنَكُمَا بِكِتَابِ اللَّهِ الْمِائَةُ شَاةٍ وَالْخَادِمُ رَدٌّ عَلَيْكَ وَعَلَى ابْنِكَ جَلْدُ مِائَةٍ وَتَغْرِيبُ عَامٍ وَاغْدُ أَنْتَ يَا أُنَيْسُ عَلَى امْرَأَةِ هَذَا فَإِنِ اعْتَرَفَتْ فَارْجُمْهَا فَغَدَا عَلَيْهَا فَاعْتَرَفَتْ فَرَجَمَهَا
English Translation
Ahmad ibn 'Abdah narrated to us: Sufyan ibn 'Uyaynah narrated to us, from al-Zuhri, from 'Ubayd Allah, from Abu Hurayrah and Zayd ibn Khalid and Shibl, may Allah be well pleased with them, who said: We were with the Messenger of Allah, blessings and peace of Allah be upon him, when a man stood up and said: "I implore you by Allah to judge between us by the Book of Allah." His opponent, who was more knowledgeable in jurisprudence, stood up and said: "Yes, judge between us by the Book of Allah, and allow me to speak." He said: "Speak." He said: "My son was a hired worker for this man, and he committed adultery with his wife. I was told that my son deserved stoning, so I ransomed him with a hundred sheep and a servant. Then I asked men of knowledge, and they informed me that my son deserved a hundred lashes and exile for one year, and that this man's wife deserved stoning." The Prophet, blessings and peace of Allah be upon him, said: "By the One in Whose hand is my soul, I will judge between you by the Book of Allah. The hundred sheep and the servant are to be returned to you. Your son is to receive a hundred lashes and be exiled for one year. And go, O Unays, to this man's wife, and if she confesses, stone her." So he went to her and she confessed, and he stoned her.
