وَأَخْبَرَنَا أَبُو بَكْرِ بْنُ فُورَكٍ أنبأ عَبْدُ اللهِ بْنُ جَعْفَرٍ ثنا يُونُسُ بْنُ حَبِيبٍ أنبأ أَبُو دَاوُدَ ثنا شُعْبَةُ عَنْ قَيْسِ بْنِ مُسْلِمٍ قَالَ سَمِعْتُ طَارِقَ بْنَ شِهَابٍ يُحَدِّثُ عَنْ أَبِي مُوسَى قَالَ قَدِمْتُ عَلَى النَّبِيِّ ﷺ وَهُوَ مُنِيخٌ بِالْبَطْحَاءِ فَقَالَ لِي كَيْفَ أَهْلَلْتَ ؟ قَالَ قُلْتُ لَبَّيْكَ بِإِهْلَالٍ كَإِهْلَالِ النَّبِيِّ ﷺ قَالَ أَحْسَنْتَ طُفْ بِالْبَيْتِ وَبَيْنَ الصَّفَا وَالْمَرْوَةِ ثُمَّ أَحِلَّ فَذَكَرَ الْحَدِيثَ أَخْرَجَاهُ فِي الصَّحِيحِ مِنْ حَدِيثِ شُعْبَةَ وَفِي رِوَايَةِ طَاوُسٍ أَنَّ النَّبِيَّ ﷺ خَرَجَ مِنَ الْمَدِينَةِ لَا يُسَمِّي حَجًّا وَلَا عُمْرَةً يَنْتَظِرُ الْقَضَاءَ فَنَزَلَ عَلَيْهِ الْقَضَاءُ وَهُوَ بَيْنَ الصَّفَا وَالْمَرْوَةِ فَأَمَرَ مَنْ كَانَ مِنْهُمْ أَهَلَّ وَلَمْ يَكُنْ مَعَهُ هَدْيٌ أَنْ يَجْعَلَهَا عُمْرَةً وَأَكَّدَ الشَّافِعِيُّ رَحِمَهُ اللهُ هَذِهِ الرِّوَايَةَ الْمُرْسَلَةَ بِأَحَادِيثَ مَوْصُولَةٍ رُوِيَتْ فِي إِحْرَامِهِمْ تَشْهَدُ لِرِوَايَةِ طَاوُسٍ بِالصِّحَّةِ
English Translation
Abu Musa said: 'I came to the Prophet (peace be upon him) while he was camped at al-Batha. He said to me: How did you enter ihram? I said: Labbayk with a talbiyah like the talbiyah of the Prophet (peace be upon him). He said: You have done well. Perform tawaf around the House and between al-Safa and al-Marwah, then release your ihram.' He then mentioned the hadith. Both (al-Bukhari and Muslim) reported it in the Sahih from the hadith of Shu'bah. In the narration of Tawus, the Prophet (peace be upon him) departed from Madinah without specifying Hajj or Umrah, waiting for the divine decree. The decree came down while he was between al-Safa and al-Marwah, so he commanded those among them who had entered ihram without bringing a sacrificial animal to make it an Umrah. Al-Shafi'i (may Allah have mercy on him) supported this mursal narration with connected (mawsul) hadiths that were narrated regarding their ihram, which testify to the authenticity of Tawus' narration.
