أَخْبَرَنَا أَبُو بَكْرٍ أَحْمَدُ بْنُ الْحَسَنِ الْقَاضِي وَأَبُو زَكَرِيَّا بْنُ أَبِي إِسْحَاقَ الْمُزَكِّي قَالَا ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ أنبأ مُحَمَّدُ بْنُ عَبْدِ اللهِ بْنِ عَبْدِ الْحَكَمِ أنبأ ابْنُ وَهْبٍ أَخْبَرَنِي عَمْرُو بْنُ الْحَارِثِ وَهِشَامُ بْنُ سَعْدٍ عَنْ عَمْرِو بْنِ شُعَيْبٍ عَنْ أَبِيهِ عَنْ عَبْدِ اللهِ بْنِ عَمْرِو بْنِ الْعَاصِ أَنَّ رَجُلًا مِنْ مُزَيْنَةَ أَتَى رَسُولَ اللهِ ﷺ فَقَالَ يَا رَسُولَ اللهِ كَيْفَ تَرَى فِي حَرِيسَةِ الْجَبَلِ؟ قَالَ هِيَ وَمِثْلُهَا وَالنَّكَالُ لَيْسَ فِي شَيْءٍ مِنَ الْمَاشِيَةِ قَطْعٌ إِلَّا فِيمَا آوَاهُ الْمُرَاحُ وَبَلَغَ ثَمَنَ الْمِجَنِّ فَفِيهِ قَطْعُ الْيَدِ وَمَا لَمْ يَبْلُغْ ثَمَنَ الْمِجَنِّ فَفِيهِ غَرَامَةُ مِثْلَيْهِ وَجَلَدَاتُ نَكَالٍ قَالَ يَا رَسُولَ اللهِ فَكَيْفَ تَرَى فِي الثَّمَرِ الْمُعَلَّقِ؟ قَالَ هُوَ وَمِثْلُهُ مَعَهُ وَالنَّكَالُ وَلَيْسَ فِي شَيْءٍ مِنَ الثَّمَرِ الْمُعَلَّقِ قَطْعٌ إِلَّا مَا آوَاهُ الْجَرِينُ فَمَا أَخَذَ مِنَ الْجَرِينِ فَبَلَغَ ثَمَنَ الْمِجَنِّ فَفِيهِ الْقَطْعُ وَمَا لَمْ يَبْلُغْ ثَمَنَ الْمِجَنِّ فَفِيهِ غَرَامَةُ مِثْلَيْهِ وَجَلَدَاتُ نَكَالٍ قَالَ فَكَيْفَ تَرَى فِيمَا يُؤْخَذُ فِي الطَّرِيقِ الْمِئْتَاءِ أَوِ الْقَرْيَةِ الْمَسْكُونَةِ؟ قَالَ عَرِّفْهُ سَنَةً فَإِنْ جَاءَ بَاغِيهِ فَادْفَعْهُ إِلَيْهِ وَإِلَّا فَشَأْنَكَ بِهِ فَإِنْ جَاءَ طَالِبُهُ يَوْمًا مِنَ الدَّهْرِ فَأَدِّهِ إِلَيْهِ فَمَا كَانَ فِي الطَّرِيقِ غَيْرِ الْمِئْتَاءِ وَفِي الْقَرْيَةِ غَيْرِ الْمَسْكُونَةِ فَفِيهِ وَفِي الرِّكَازِ الْخُمُسُ قَالَ يَا رَسُولَ اللهِ فَكَيْفَ تَرَى فِي ضَالَّةِ الْغَنَمِ؟ قَالَ طَعَامٌ مُأْكُولٌ لَكَ أَوْ لِأَخِيكَ أَوْ لِلذِّئْبِ احْبِسْ عَلَى أَخِيكَ ضَالَّتَهُ قَالَ يَا رَسُولَ اللهِ فَكَيْفَ تَرَى فِي ضَالَّةِ الْإِبِلِ فَقَالَ مَا لَكَ وَلَهَا مَعَهَا سِقَاؤُهَا وَحِذَاؤُهَا وَلَا يُخَافُ عَلَيْهَا الذِّئْبَ تَأْكُلُ الْكَلَأَ وَتَرِدُ الْمَاءَ دَعْهَا حَتَّى يَأْتِيَ طَالِبُهَا مَنْ قَالَ بِالْأَوَّلِ أَجَابَ عَنْ هَذَا بِأَنَّ هَذَا الْخَبَرَ وَرَدَ فِيمَا يُوجَدُ مِنْ أَمْوَالِ الْجَاهِلِيَّةِ ظَاهِرًا فَوْقَ الْأَرْضِ فِي الطَّرِيقِ غَيْرِ الْمِئْتَاءِ وَفِي الْقَرْيَةِ غَيْرِ الْمَسْكُونَةِ فَيَكُونُ فِيهِ وَفِي الرِّكَازِ الْخُمُسُ وَلَيْسَ ذَلِكَ مِنَ الْمَعْدِنِ بِسَبِيلٍ وَذَكَرَ الشَّافِعِيُّ فِي رِوَايَةِ الزَّعْفَرَانِيِّ عَنْهُ اعْتِلَالَهُمْ بِالْحَدِيثِ الْأَوَّلِ ثُمَّ قَالَ هُوَ عِنْدَ أَهْلِ الْحَدِيثِ ضَعِيفٌ وَذَكَرَ اعْتِلَالَهُمْ بِحَدِيثِ هِشَامِ بْنِ سَعْدٍ عَنْ عَمْرِو بْنِ شُعَيْبٍ هَذَا ثُمَّ قَالَ إِنْ كَانَ حَدِيثُ عَمْرٍو يَكُونُ حُجَّةً فَالَّذِي رَوَى حُجَّةٌ عَلَيْهِ فِي غَيْرِ حُكْمٍ وَإِنْ كَانَ حَدِيثُ عَمْرٍو غَيْرَ حُجَّةٍ فَالْحُجَّةُ بِغَيْرِ حُجَّةٍ جَهْلٌ ثُمَّ ذَكَرَ مُخَالَفَتَهُمُ الْحَدِيثَ فِي الْغَرَامَةِ وَفِي التَّمْرِ الرُّطَبِ إِذَا آوَاهُ الْجَرِينُ وَفِي اللُّقَطَةِ ثُمَّ قَالَ فَخَالَفَ حَدِيثَ عَمْرٍو الَّذِي
English Translation
Abu Bakr Ahmad ibn al-Hasan al-Qadi and Abu Zakariyya informed us... from Amr ibn Shu'ayb from his father from Abdullah ibn Amr ibn al-As that a man from Muzaynah came to the Messenger of Allah (peace be upon him) and said: 'O Messenger of Allah, what do you say about a sheep stolen from a mountain pasture?' He said: 'It and its like value and a penalty. There is no cutting of the hand for any livestock except what is housed in its pen and reaches the value of a shield - for that the hand is cut. What does not reach the value of a shield, there is a penalty of double its value and lashes as punishment.' He said: 'O Messenger of Allah, what about hanging fruit?' He said: 'It and its like value and a penalty. There is no cutting for any hanging fruit except what is housed in the drying area. Whatever is taken from the drying area and reaches the value of a shield, the hand is cut. What does not reach the value of a shield, there is a penalty of double its value and lashes.' He asked: 'What about what is found on a well-traveled road or in an inhabited village?' He said: 'Announce it for a year. If its owner comes, return it to him. Otherwise, do with it as you wish. If its seeker comes any day, return it to him. As for what is found on an untraveled road or in an uninhabited village, in it and in buried treasure there is the fifth.' He asked about lost sheep, and the Prophet said: 'It is food to be eaten - for you, your brother, or the wolf. Keep your brother's stray for him.' He asked about stray camels, and the Prophet said: 'What have you to do with them? They have their water bags and their hooves, and the wolf is not feared for them. They eat vegetation and come to water. Leave them until their owner comes.' The Shaykh discussed the scholarly interpretations of this narration.
