أَخْبَرَنَاهُ أَبُو عَبْدِ اللهِ الْحَافِظُ وَأَبُو بَكْرٍ الْقَاضِي قَالَا ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ ثنا إِبْرَاهِيمُ بْنُ مَرْزُوقٍ ثنا رَوْحٌ عَنِ الثَّوْرِيِّ عَنْ لَيْثٍ ثنا زِيَادُ بْنُ كُلَيْبٍ عَنْ إِبْرَاهِيمَ قَالَ الْأَيْمَانُ أَرْبَعٌ يَمِينَانِ يُكَفَّرَانِ وَيَمِينَانِ لَا يُكَفَّرَانِ قَوْلُ الرَّجُلِ وَاللهِ مَا فَعَلْتُ وَاللهِ لَقَدْ فَعَلْتُ لَيْسَ فِي شَيْءٍ مِنْهُ كَفَّارَةٌ إِنْ كَانَ تَعَمَّدَ شَيْئًا فَهُوَ كَذِبٌ وَإِنْ كَانَ يَرَى أَنَّهُ كَمَا قَالَ فَهُوَ لَغْوٌ وَقَوْلُ الرَّجُلِ وَاللهِ لَا أَفْعَلُ وَوَاللهِ لَأَفْعَلَنَّ فَهَذَا فِيهِ كَفَّارَةٌ قَالَ الشَّيْخُ وَلَيْثٌ وَحَمَّادُ بْنُ أَبِي سُلَيْمَانَ غَيْرُ مُحْتَجٍّ بِهِمَا وَاللهُ أَعْلَمُ وَرُوِيَ مِنْ وَجْهٍ آخَرَ عَنِ ابْنِ مَسْعُودٍ
English Translation
Ibrahim said: Oaths are of four types - two that require expiation and two that do not. When a man says 'By Allah, I did not do it' or 'By Allah, I did it' - there is no expiation in either of these; if he did it deliberately, it is a lie, and if he thinks it is as he said, it is idle talk (laghw). But when a man says 'By Allah, I will not do it' or 'By Allah, I will certainly do it' - these require expiation. The shaykh said: Layth and Hammad ibn Abi Sulayman are both not relied upon as authorities. It was also narrated from another chain from Ibn Mas'ud.
