أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ أنبأ مُحَمَّدُ بْنُ جَعْفَرٍ الْعَدْلُ أنبأ يَحْيَى بْنُ مُحَمَّدٍ ثنا عُبَيْدُ اللهِ بْنُ مُعَاذٍ ثنا أَبِي ثنا شُعْبَةُ عَنْ تَمِيمِ بْنِ حُوَيَصٍ يَعْنِي الْمِصْرِيَّ قَالَ اشْتَرَيْتُ شَاةً بِمِنًى أُضْحِيَّةً فَضَلَّتْ فَسَأَلْتُ ابْنَ عَبَّاسٍ ؓ عَنْ ذَلِكَ فَقَالَ لَا يَضُرُّكَ قَالَ الشَّافِعِيُّ وَلَكِنَّهُ إِنْ وَجَدَهَا بَعْدَ مَا أَوْجَبَهَا ذَبَحَهَا وَإِنْ مَضَتْ أَيَّامُ النَّحْرِ كَمَا يَصْنَعُ فِي الْبُدْنِ مِنَ الْهَدْيِ
English Translation
Abu Abdullah al-Hafiz informed us, Muhammad ibn Ja'far al-'Adl informed us, Yahya ibn Muhammad narrated to us, Ubayd Allah ibn Mu'adh narrated to us, my father narrated to us, Shu'bah narrated to us from Tamim ibn Huways - meaning the Egyptian - who said: I bought a sheep at Mina as a sacrifice, and it went missing. I asked Ibn Abbas (may Allah be pleased with him) about it, and he said: "It does not harm you." Al-Shafi'i said: But if he finds it after having designated it, he should slaughter it even if the days of sacrifice have passed, just as he does with sacrificial camels.
