أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ أنبأ الرَّبِيعُ بْنُ سُلَيْمَانَ قَالَ قَالَ الشَّافِعِيُّ فَإِنْ قَالَ قَائِلٌ مَا دَلَّ عَلَى أَنَّهُ اخْتِيَارٌ لَا وَاجِبٌ؟ يَعْنِي الْأَخْذَ مِنَ الشَّعْرِ وَالظُّفُرِ قِيلَ لَهُ رَوَى مَالِكٌ عَنْ عَبْدِ اللهِ بْنِ أَبِي بَكْرٍ عَنْ عَمْرَةَ عَنْ عَائِشَةَ ؓ قَالَتْ أَنَا فَتَلْتُ قَلَائِدَ هَدْيِ رَسُولِ اللهِ ﷺ بِيَدِي ثُمَّ قَلَّدَهَا رَسُولُ اللهِ ﷺ بِيَدِهِ ثُمَّ بَعَثَ بِهَا مَعَ أَبِي فَلَمْ يَحْرُمْ عَلَى رَسُولِ اللهِ ﷺ شَيْءٌ أَحَلَّ اللهُ لَهُ حَتَّى نَحَرَ الْهَدْيَ قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ وَفِي هَذِهِ دَلَالَةٌ عَلَى مَا وَصَفْتُ وَعَلَى أَنَّ الْمَرْءَ لَا يُحْرِمُ بِالْبِعْثَةِ بِهَدْيِهِ يَقُولُ الْبِعْثَةُ بِالْهَدْيِ أَكْثَرُ مِنْ إِرَادَةِ الضَّحِيَّةِ
English Translation
Abu Abdullah al-Hafiz informed us, Abu al-Abbas Muhammad ibn Ya'qub narrated to us, al-Rabi' ibn Sulayman informed us. Al-Shafi'i said: If someone asks: "What indicates that it is a choice and not an obligation?" - meaning refraining from hair and nails - the answer is: Malik narrated from Abdullah ibn Abi Bakr, from Amrah, from Aisha (may Allah be pleased with her) who said: "I twisted the garlands of the sacrificial animals of the Messenger of Allah (peace and blessings be upon him) with my own hands, then the Messenger of Allah (peace and blessings be upon him) garlanded them with his own hands, then sent them with my father. Nothing that Allah had made lawful for the Messenger of Allah (peace and blessings be upon him) became forbidden to him until the sacrificial animals were slaughtered." Al-Shafi'i (may Allah have mercy on him) said: In this is evidence for what I have described, and that a person does not enter the state of ihram by sending his sacrificial animal. He says: Sending the sacrificial animal is a greater act than merely intending to sacrifice.
