أَخْبَرَنَا أَبُو أَحْمَدَ الْمِهْرَجَانِيُّ أنبأ أَبُو بَكْرِ بْنُ جَعْفَرٍ ثنا مُحَمَّدُ بْنُ إِبْرَاهِيمَ ثنا ابْنُ بُكَيْرٍ ثنا مَالِكٌ عَنِ ابْنِ شِهَابٍ أَنَّ عَبْدَ الْمَلِكِ بْنَ مَرْوَانَ قَضَى فِي امْرَأَةٍ أُصِيبَتْ مُسْتَكْرَهَةً بِصَدَاقِهَا عَلَى مَنْ فَعَلَ ذَلِكَ بِهَا وَرُوِّينَا عَنِ ابْنِ جُرَيْجٍ عَنْ عَطَاءٍ قَالَ عَلَيْهِ الْحَدُّ وَالصَّدَاقُ وَعَنِ الْحَسَنِ قَالَ عَلَيْهِ الْحَدُّ وَالْعُقْرُ وَعَنِ الزُّهْرِيِّ عَلَيْهِ الصَّدَاقُ وَالْحَدُّ
English Translation
Narrations about the waiving of the hadd punishment for those who are coerced or forced into unlawful acts. The Prophet (peace be upon him) established that there is no hadd for one who is coerced, based on the principle that "My ummah is pardoned for what they are coerced into." The woman who is raped bears no sin and no punishment.
