وَأَخْبَرَنَا أَبُو بَكْرِ بْنُ الْحَارِثِ أنا عَلِيُّ بْنُ عُمَرَ الْحَافِظُ نا أَبُو بَكْرٍ النَّيْسَابُورِيُّ نا يُوسُفُ بْنُ سَعِيدٍ نا حَجَّاجٌ عَنِ ابْنِ جُرَيْجٍ أَخْبَرَنِي أَبُو الزُّبَيْرِ أَنَّ ثَابِتَ بْنَ قَيْسِ بْنِ شِمَاسٍ كَانَتْ عِنْدَهُ زَيْنَبُ بِنْتُ عَبْدِ اللهِ بْنِ أُبَيٍّ ابْنِ سَلُولَ وَكَانَ أَصْدَقَهَا حَدِيقَةً فَكَرِهَتْهُ فَقَالَ النَّبِيُّ ﷺ أَتَرُدِّينَ عَلَيْهِ حَدِيقَتَهُ الَّتِي أَعْطَاكِ؟ قَالَتْ نَعَمْ وَزِيَادَةً فَقَالَ النَّبِيُّ ﷺ أَمَّا الزِّيَادَةُ فَلَا وَلَكِنْ حَدِيقَتَهُ فَقَالَتْ نَعَمْ فَأَخَذَهَا لَهُ وَخَلَّى سَبِيلَهَا فَلَمَّا بَلَغَ ذَلِكَ ثَابِتَ بْنَ قَيْسِ بْنِ شِمَاسٍ ؓ قَالَ قَدْ قَبِلْتُ قَضَاءَ رَسُولِ اللهِ ﷺ سَمِعَهُ أَبُو الزُّبَيْرِ مِنْ غَيْرِ وَاحِدٍ وَهَذَا أَيْضًا مُرْسَلٌ
English Translation
Abu al-Zubayr narrated that Thabit ibn Qays ibn Shammas was married to Zaynab bint Abdullah ibn Ubayy ibn Salul, and he had given her a garden as mahr. She disliked him, so the Prophet (peace be upon him) said: 'Will you return to him the garden he gave you?' She said: 'Yes, and more.' The Prophet (peace be upon him) said: 'As for the extra, no, but his garden.' She said: 'Yes.' So he took it for him and let her go. When that reached Thabit ibn Qays ibn Shammas (may Allah be pleased with him), he said: 'I accept the judgment of the Messenger of Allah (peace be upon him).' Abu al-Zubayr heard this from more than one person. This is also a mursal narration.
